If I am caught shoplifting, will that go on my record?

If you're convicted, or charged and arraigned, for any crime, it's going to go on your record. There are different gradations in terms of shoplifting and theft, depending upon the value of the items. However, these are crimes, still. So if a criminal complaint does issue, and if there is a guilty, that guilty will be on your record, just like the initial arraignment, the initial case, as well as what happened to that case, will be on your record. Can I be deported if I'm convicted of domestic violence in Massachusetts?

If you have a conviction for any type of crime, particularly certain types of crime, like domestic violence, you can absolutely be deported. Immigration takes those things, those types of cases, extremely seriously. I'm Sam Goldberg, lead counsel for criminal defense matters at Altman & Altman, in Cambridge, Massachusetts. What should I do if I've been pulled over for drunk driving in Massachusetts?

I've seen a lot of cases that were originally drunk driving cases, where the person was pulled over, they overreacted, and try to outrun or out talk the police officer, and they end up making the case worse. What you should do is politely comply, not volunteer any statements or explanations like "I only had 2 beers, officer." You have a right to take or not take field sobriety tests and the breathalyzer test. If you refuse to take the breathalyzer test, you'll lose your license for a certain amount of time. But if you've been drinking and you take the breathalyzer test, you fail, and you get convicted of drunk driving, and you're going to lose your license for longer. Will I go to jail for a drunk driving conviction in Massachusetts?

In Massachusetts you could potentially go to jail if convicted for drunk driving. Usually, particularly in the first offense, there's a statutory provision, that would allow for you not going to jail, and not actually getting a guilty conviction. That will depend on the circumstances, your representation as well. But anything after that, you very easily could go to jail. What is your experience defending people accused of muder?

I've been handling homicide cases for many years, starting with being a prosecutor in New York during which time I spent a year prosecuting nothing but homicide cases. I know how the prosecutors think. I know what the judges are concerned about. I know the defenses. I know the tactics. I also know how to get that steel in your gut so that you can vigorously, no matter what accusations there are, defend your client to the best of your ability. What constitutes an armed assault and battery in Massachusetts?

In Massachusetts, an armed assault and battery is really an assault and battery with a dangerous weapon. That dangerous weapon can be anything. It can be a shoe. You've probably heard of assault and battery with a shoed foot, that's a foot with a shoe in it. It can be a gun, it can be a car, it can be a pencil. It can be anything. The fact is any item can be used as a weapon. If any item is used as a weapon, it's armed assault. Should I have an attorney at my probation violation hearing?

In Massachusetts, I would say youíre basically crazy if you donít have an attorney represent you in a probation violation. As a matter of fact, very often, you have an absolute right to be represented and if you canít afford an attorney youíre indigent and the court will assign you somebody. But, the fact is, even if thatĎs not the case, and you donít qualify for court-appointed counsel, you've got to have an attorney thatís experienced in dealing with probation violation hearings. Theyíre animals in and of themselves, different from other criminal cases. And, without that representation, youíre probably going on a voyage. Is domestic violence a felony crime or a misdemeanor?

Domestic violence is a type, or category, of crime. There is no actual offense called domestic violence. It would be the setting of where the crime took place, for example the crime could be assault and battery that took place in the home. That's a domestic violence case. It depends on whether or not that underlying offense is a misdemeanor or a felony. For example, if it's just straight assault and battery, well that's a misdemeanor. It's a domestic violence case, it's a misdemeanor. If it's assualt and battery with a dangerous weapon, which could be anything including a shoe, it's a felony. Domestic violence, but still a felony. So you've got to look for the underlying defense, and that will determine whether it's a felony or misdemeanor. What is your experience handling criminal defense cases in Massachusetts?

I've been handling criminal defense cases in Massachusetts since 1990. Obviously, I have a great deal of experience handling a wide variety of criminal cases. And I have something more than that. I have previous years experience being a prosecutor, both as a student prosecutor in Massachusetts, and a prosecutor handling anything from assault to homicide, in New York. I know how the other side thinks, I know how to handle a criminal case. I certainly know my way around the court room. That's the experience that I bring to my client's representation.
