- Family and Divorce
Our firm handles a full range of family law matters, including:
* Divorce and Legal Separation
At Bailey & Galyen, most of our Texas divorce attorneys are board certified by the Texas Board of Legal Specialization; consequently, we are prepared to provide you with quality legal representation in a compassionate and caring environment, where privacy and confidentiality are paramount.
* Child Support
Most divorcing couples agree that the best interests of their children are paramount. The Texas child support lawyers at Bailey & Galyen will work hard to secure the continuing financial support necessary for the well-being of children in divorce situations. Contact the firm for further assistance. Our telephones are answered 24 hours a day.
* Child Custody
In times past, most courts granted child custody almost exclusively to the mother. Currently, courts in most cases tend to favor joint custody arrangements for the children. If you believe that this is not in the best interest of your children, contact the firm immediately to discuss the matter with one of our Texas child custody lawyers. The sooner we are involved in the process, the greater your chances are for success in obtaining child custody.
Non-custodial parents are almost always awarded visitation rights by the family court. Implementing child visitation can create significant conflict between former spouses. If you are having difficulties implementing child visitation, contact the Texas child visitation attorneys at Bailey & Galyen for an initial consultation.
* Alimony (Spousal Maintenance)
Permanent alimony, (spousal support or spousal maintenance), is generally not granted in divorce proceedings any more. The courts only award spousal support on a temporary basis, and sometimes award support to the husband, (where the wife was the primary wage earner and the husband supported her in her career efforts). Contact the Texas alimony attorneys at Bailey & Galyen for answers to your Texas spousal maintenance questions.
Texas now requires mediation as part of the divorce process. The Texas divorce and mediation lawyers at Bailey & Galyen can provide you with mediation services as part of your divorce process. Contact the firm for a free initial consultation. And remember, our telephones are answered 24 hours a day for your convenience.

- Wills, Living Wills, Probate & Trusts
It has been said that nothing is certain but death and taxes; nevertheless, many people defer their estate planning almost indefinitely. At the Texas probate law firm of Bailey & Galyen, we understand that wills, probate, and trusts are an essential part of life planning. Our law firm provides comprehensive estate planning and estate administration, including:
A Will is a written, legal document that provides details and instructions for the disposition of a decedent's (dead person's) property. This can be used to explain how property is to be allocated and who would be responsible for carrying out your wishes.
A Trust is a type of legal entity which is used to hold legal title to property (usually the decedent's) for the benefit of one or more persons. This is commonly used in conjunction with a will, so that real or personal property is properly distributed after your passing.
* Living Wills
Also called a Directive to Physicians, this document will direct your medical care in the event you become incapacitated or are unable to communicate your wishes to your health care providers.
* Durable Powers of Attorney (medical and financial)
This document designates specific people to handle certain tasks on your behalf if you are unable to do so. This can be applied to health care, to designate specific people to administer care or to serve as implied consent; or to property, so that designated people can handle your affairs on your behalf.
* Probate / Estate Administration
The primary goal of the probate process is to promote the orderly distribution of an estate. At Bailey & Galyen, we prepare all documents necessary to bring about the orderly distribution of the estate. Our knowledgeable and compassionate lawyers and staff can help you during this important time. Call today for a free initial consultation.
- Securities Fraud
Recently, several national full-service brokerage houses have paid large fines for negligence in the handling of investors' savings. Billions of dollars have been lost because of the failure of these brokers to use a reasonable standard of care with investor money.
Many investors are embarrassed to speak-up about their losses. Some feel there is nothing they can do. But there is something they can do, and many have. They have recovered some or all of their losses when those losses were the result of broker mistakes.
Some common examples of these mistakes include:
• Unsuitable recommendations or investments
• Unjustified risk for an investor's objectives
• Misrepresentation or omission of risks
• Churning (excessive trading to boost commissions)
• Failing to follow instructions
• Unauthorized investments
• Conflicts of interest

Hiring the Right Attorney is Critical! Some Common Pitfalls to Avoid
To draw an analogy, think of a burst pipe in your kitchen — water gushing everywhere, running into the next room and ruining your rugs and furniture, and creating a large mess. You want to bring in a plumber who can fix the problem at the source, not merely put a Band-Aid on it. We all know this is the right way to go about it because we know how it plays out if we do not — the numerous plumber visits, the time taken off from work to meet the plumber, the mess you’re left to clean up.Read Article

Divorce and Bankruptcy
Unfortunately, one of the leading causes of personal bankruptcy is divorce. The good news is that bankruptcy can give you a fresh start and a higher degree of financial separation from a former spouse.Read Article

Call for a Nationwide Ban on Cell Phones and Texting while Driving
In December, the National Transportation Safety Board (NTSB) called for a nationwide ban on all cell phone use while driving. This goes beyond the hands-free laws enacted by ten states. Distracted driving causes more 6000 crashes and 3000 deaths each year.Read Article

Mr. Schwartz was born and raised in Galveston, Texas. Mr. Schwartz is the son of former State Senator and Mrs. A.R. "Babe" Schwartz. Babe Schwartz, also born and raised in Galveston, worked on every major legislative committee while in the House of Representatives and Senate.
Mr. Schwartz is a graduate of the University of California at San Diego and South Texas College of Law. He was admitted to the State Bar of Texas in 1982. Mr. Schwartz is a trial attorney licensed to practice law in every state and federal court in the State of Texas. He is admitted to the Fifth Circuit Court of Appeals sitting in New Orleans, Louisiana, which court considers appeals from federal courts in Texas, Mississippi and Louisiana. Mr. Schwartz is also licensed to practice law in the state of Missouri. In addition to the State Bars of Texas and Missouri, Mr. Schwartz holds memberships in the American Association for Justice (formerly known as the Association of Trial Lawyers of America), the Texas Trial Lawyers Association, the Houston Trial Lawyers Association, and the Houston Bar Association. After serving on the Houston Trial Lawyers Association's Board of Directors, Secretary/Treasurer, and Vice President, and president-elect for 2003-2004, Mr. Schwartz served as the Houston Trial Lawyers' Association President in the October, 2004 - October, 2005 term. Mr. Schwartz served as the President of the Houston Trial Lawyers' Foundation from the end of his Houston Trial Lawyers' Association Presidency in October, 2005 through October, 2008. Mr. Schwartz is also currently a Member of the Board of Directors of the Texas Trial Lawyers' Association, and has been an invited member of its Executive Committee.
Mr. Schwartz started his legal career with his father's law firm, handling general civil litigation matters and representing clients' interests as a lobbyist before the Texas Legislature. After four years, Mr. Schwartz's concentrated interest in litigation resulted in his establishing his own law practice and office in Houston. For the next 11 years, Mr. Schwartz maintained a successful, general civil law practice. Mr. Schwartz's general civil practice consisted of handling all types of personal injury cases, ranging from premises liability, motor vehicle collisions and product liability, as well as business litigation cases, cases involving violations of the Texas Deceptive Trade Practices Act and of the Texas Insurance Code. From mid 1990 through November, 1996, Mr. Schwartz was also "of counsel" to the long tenured Houston oil and gas law firm, Wilson & Johnson. Mr. Schwartz handled the business and oil and gas litigation matters for Wilson & Johnson's oil and gas industry clients.
Mr. Schwartz joined the Williams Bailey Law Firm (now known as Williams Kherkher) in November, 1996. Mr. Schwartz's first docket management assignment at the Williams Bailey Law Firm was the representation of approximately 680 plaintiffs in state court litigation involving personal injuries and damages resulting from the development of a residential subdivision on a toxic waste superfund site in Friendswood, Texas. After the successful conclusion of that litigation, Mr. Schwartz worked on the Texas Tobacco Litigation as a member of Williams Bailey's Texas Tobacco Litigation team, participating in the discovery phase of that complex, federal court litigation, and later managing the law office established in Texarkana, Texas, by the five Texas Tobacco Litigation law firms for the trial of that case. The Texas Tobacco Litigation concluded with a historic settlement where the tobacco industry agreed to pay the state of Texas $15 billion over 25 years and to pay approximately $2.3 billion through 2003 to Texas counties and hospital districts based on their provision of indigent health care. Mr. Schwartz then started the pharmaceutical docket at Williams Bailey with the 3,000 clients in the Fen-Phen litigation. He expanded the pharmaceutical docket to represent seriously injured victims of other dangerous prescription drugs, over-the-counter remedies and dietary supplements. After nearly 7 1/2 years with the Williams Bailey Law Firm, Mr. Schwartz joined Bailey & Galyen on March 1, 2004, to start and manage a mass tort and pharmaceutical department.
Mr. Schwartz has extensive, successful mass tort, pharmaceutical, state and federal consolidated and Multi-District Litigation (MDL), and trial experience. He brings with him an aggressive, ethical attitude, a proactive approach, and a strong work ethic in order to achieve our collective goal of providing the best representation possible for Bailey & Galyen's clients.
