Areas of Law Description
- Criminal Defense
As experienced New Orleans criminal defense counsel, Bloom Legal has represented clients throughout the state of Louisiana facing a range of criminal charges, from criminal traffic violations, to drugs, domestic issues, theft, prostitution, physical battery and expungements. Bloom Legal has established relationships with criminal court judges and prosecutors not only in New Orleans, but throughout the state of Louisiana, to ensure the most fair and reasonable results for our criminal defense clients.
- Burglary
Burglary in Louisiana is defined as the unlawful entry into a structure with intent to commit crime inside. Burglary is not necessarily the same crime as breaking and entering -- a person can commit burglary simply by trespassing through an open door, if they intend to commit a crime once they are inside.
- Armed Robbery
In Louisiana, Armed Robbery is defined as the taking or stealing of anything of value from another person, without their consent, by the use of force or intimidation, while armed with a dangerous weapon like a gun or a knife.
- Traffic Tickets
If you have received a traffic ticket in the state of Louisiana, you need a traffic attorney to protect your driving record. Traffic tickets may seem like a nuisance, but they can have a big impact. Ticket problems on your driving record may result in costly, higher insurance premiums; points on your license; and they can eventually lead to your license being suspended.
- DWI or DUI
If you, or someone you know, has been arrested for DWI or DUI, it is very important that you hire an attorney fast, to make sure the result is the best possible. Deadlines under the driving drunk laws come very quickly, and they cannot be extended. Negotiating the different punishments (fines, suspensions, jail time, classes, etc.) under the law requires skill and experience.
- White Collar Crime
According to the criminologist Edwin Sutherland, white collar crimes are those "committed by a person of respectability and high social status in the course of his occupation" (from White Collar Crime, 1949). Many white collar crimes are also called 'corporate crimes', crimes such as fraud and embezzlement that are easier for employees of larger corporations. In New Orleans, charges and accusations of white collar or corporate crimes are all too common. If you have been charged with or accused of one of these crimes, contact Bloom Legal today at 504.599.9997 to make sure your rights and your livelihood are defended.
- Wire Fraud
Wire fraud is a federal crime. Louisiana state law enforcement officials investigate and prosecute other types of fraud, such as computer fraud or credit card fraud. But if the alleged fraud involves the use of wire, radio, or television, you will be charged by federal prosecutors using federal sentencing guidelines.
- Money Laundering
According to Louisiana criminal law, money laundering involves any transaction knowingly involving proceeds from criminal activity. This covers a wide array of transactions, from those explicitly designed to "clean" the money to more innocent transactions simply involving the criminally-obtained funds. Additionally, you may be charged with money laundering if you have in any way aided or overseen the operation of a money laundering operation, even if you did not engage in any actual transactions.
- Tax Fraud / Evasion
Tax evasion and tax fraud are very closely related crimes. For either one of these offenses, you may be charged by either the state government, for failing to follow the guidelines of the Louisiana Department of Revenue (LDR), or by the federal government, for failing to follow the guidelines of the IRS. Obviously, if you are accused of evading state taxes, this will lead to a Louisiana tax evasion charge, while if you are accused of evading federal taxes you will be charged with a federal crime. Frequently, however, a person accused of Louisiana tax fraud or evasion may have committed a similar error or fraud on their federal tax returns, leading to the possibility of a federal tax charge as well.
- Extortion
Extortion in Louisiana is a felony. If convicted of this crime you will face between one and fifteen years in prison and will have to disclose your felony conviction in any future employment applications or background checks. Additionally, if certain conditions are present, your Louisiana extortion charge may be compounded by a federal extortion charge, if, for example, it was committed through any medium of "interstate commerce". Whether you need a Louisiana state or a federal extortion defense attorney, New Orleans' Bloom Legal is here to represent you.
- Embezzlement
Since it is most prevalent in corporate and workplace settings, embezzlement is considered a white collar crime. Like many other white collar crimes, charges of embezzlement often require law enforcement agencies to conduct lengthy, painstaking investigations. The best defense for an embezzlement charge begins before you've even been charged, while the investigation is ongoing.
- Sex Crimes
Whether you have been the victim of a sexual crime or you have been accused of one in Louisiana, you have certain legal rights to which you are entitled. Centrally located in the heart of downtown New Orleans, the law office of Bloom Legal is ideally situated to help clients on both sides of a sexual crime dispute. We handle all types of sexual crimes, whether in state and federal courts, and whether the victims are children or adults.
- Murder and Attempted Murder
Murder and Attempted Murder are two of the most serious criminal charges a person may face. If convicted of murder in Louisiana, you may face a severe sentence like life in prison or even death. This is a complicated section of the law and the charges and potential sentences are serious, so you need a qualified, experienced Louisiana criminal defense attorney who will work to protect your innocence and your future.
- Assault and Battery
You can be charged with assault or aggravated assault without actually striking the other person involved. While they usually appear in conjunction with battery, which is the actual act of violence, you can also be charged with only assault or aggravated assault, if you are believed to have made a credible threat of physical violence. Frequently, though, because of law enforcement's desire to look tough on crime, actions that do not involve a credible threat of violence are still charged as assault or aggravated assault. In these cases, the attorneys at Bloom Legal will work to have the charges dropped or dismissed.
- Domestic Violence
Domestic violence is a serious issue that affects marital and non-marital relationships alike. Spouses, girlfriends, boyfriends, domestic partners, co-habitating partners, and children may all potentially be victims of acts of domestic violence. Whether you are a victim or have been accused of domestic violence, you need the proper legal representation to assist you in such a difficult time. Although most domestic abuse is directed toward women, anyone may be the victim of these violent acts whether the abuse is physical, mental or emotional. In addition, both civil and criminal courses of action may be sought in domestic violence cases.
- Drug Crimes
In New Orleans and the rest of Louisiana, federal and state officials are very serious when it comes to drug-related criminal charges. Laws on both the state and federal level provide zero or close-to-zero tolerance for drug offenses. Investigators and prosecutors pursue these charges aggressively, and criminal penalties for these offenses are becoming increasingly harsh. For example, if you are convicted of simple possession of anything less than 250 grams of marijuana, you face up to 6 years in prison. And that's only if you don't have any prior criminal history.
- Shoplifting
Shoplifting is a comparatively minor crime that many people do not consider to be worth retaining a lawyer. To be true, a shoplifting charge in Louisiana is not as serious as an armed robbery or other violent crime charge. But if convicted, a seemingly minor shoplifting charge will remain on your record for years to come.
- Hate Crime
If you are convicted of a Louisiana hate crime, you will be subject to an additional sentence on top of that of the underlying offense. If the underlying offense was a misdemeanor, then your hate crime conviction will carry up to an additional six months in jail or five hundred dollar fine, or both. But if the underlying offense was a felony (for example, felony aggravated battery), then your conviction will carry up to an additional five years in jail or five thousand dollars, or both.
- Indecent Exposure or Obscenity
Much of Louisiana's obscenity law depends upon the "contemporary standards" of obscene or offensive acts. As such, there is much lee-way in what acts the state may actually define as obscene. This vague quality provides ample opportunity for a quality defense attorney to craft a strong and effective defense against these charges.
- Public Intoxication
New Orleans is very tolerant of alcohol and is one of the few places in the country where you can consume an alcoholic beverage out-of-doors. But if the party becomes out of control, you can very quickly find yourself with an arrest for public intoxication or drunk and disorderly conduct.
- Manslaughter and Negligent Homicide
According to the Louisiana legal code, homicide is defined as the killing of another person and can be divided into a number of categories. The most serious form of homicide is murder, which is intentional homicide or homicide committed in the course of a violent crime. Other types of homicide, all of which are also very serious, are manslaughter, negligent homicide, and vehicular homicide.
- Personal Injury
Personal injuries happen every day, at home, on the road, and in the workplace. Accidents happen, of course. Sometimes, however, it’s the intentional conduct of a person or a company that causes serious personal injuries to an unsuspecting victim.
- Drunk Driving
In 2007 over 30 percent of all traffic fatalities occurred as the result of drivers impaired by a blood alcohol level of .08 or greater. Making the decision to drive drunk puts the driver in a compromised situation where they are operating a vehicle at a lower and more impaired level of awareness making it more difficult if not impossible to react safely to various driving conditions. The inability to properly monitor, be aware of, and react to different conditions makes driving drunk a potentially grave risk to the intoxicated driver, passengers in the vehicle and anyone else on the road.
- Dog Bites
We represent clients who have been the victims of dog or animal bites in New Orleans, Metairie, Gretna, Harvey, and the surrounding areas. Regardless of the breed, if you have suffered from a dog bite, the owner may be responsible. You have the right to damages depending on the severity of the bite. You need Bloom Legal on your side to make sure that you know your legal rights and get the best possible compensation for your injuries.
- Slip and Fall
Slip and falls are very common accidents that can be divided into two types of categories: same level or elevated. Same level falls are more common and usually involve a surface that is slippery or easy to fall on. This can lead to serious medical injuries, from back and spinal problems to broken limbs. An elevated fall occurs from a ladder or stairs and can lead to even more serious injuries of the same type. If you or someone you know has fallen and suffered injuries from the accident, Bloom Legal can help in getting you compensation for your injuries.
- Motorcycle Accident
Motorcycle riders are at a significantly greater risk for being in an accident than someone who drives a car because motorcycles are often less immediately visible to other drivers as another car or truck would be. Inattentive drivers talking on their cell phone or otherwise not paying attention coupled with the typically decreased visibility of motorcycle riders to other drivers makes for a potentially very dangerous situation as a rider.
- Car Accident
Car crashes are a fact of life in New Orleans, Metairie, Gretna and anywhere else. From minor fender benders in a parking lot, to serious fatalities on the freeway, odds are high that you - or someone you know - have been involved in at least one car crash.
- Wrongful Death
Sometimes, the personal injuries caused by another are so serious that the victim does not survive. Car crashes, construction accidents, plane crashes, medical mistakes, even defective products can be one of the many causes of these tragedies. In fact, this situation is so serious that every state in the union has passed special laws, called “Wrongful Death Statutes,” to deal with this horrible unfairness.
- Boating Accident
Louisiana and Gulf Coast residents enjoy access to The Gulf of Mexico, Lake Pontchartrain and a vast array of other rivers and bayous. Personal watercrafts ranging from fishing boats, ski boats, pleasure barges and even jet skis are a popular pastime. While being out on the water can be fun, it can also be a potentially dangerous undertaking. With so many boaters on the water and the increase in popularity of smaller and quicker personal watercraft devices such as jet skis, there is the increased probability of being involved in a boating accident.
- Truck Accidents
We all know the feeling of looking in our rearview mirror and seeing an 18 wheeler right behind us. This feeling can be unnerving and can put your safety as well as those around you at great risk. The simple fact is that when 18 wheelers drive like they own the road, they can cause car accidents with devastating results. The magnitude of size and the weight of an 18 wheeler, combined with the driver's financial motivations to get their trailer as quickly as they can to its destination, may be a recipe for disaster. If you or a loved one has been involved in an accident with an 18 wheeler, you need proper legal representation to fully develop your case.
- Head and Brain Injury
After suffering a traumatic head or brain injury, the road to recovery may be long and uncertain. Severe trauma to the head is most often caused by motor vehicle accidents, especially those involving motorcycles. Whether your head hit the window in a side impact or you experienced whiplash as the result of a rear end collision, a brain injury is traumatic. In addition to motor vehicle accidents, serious head trauma may also result from a slip and fall accident, a blow to the head during a sporting event, working around heavy machinery or industrial equipment and a variety of other situations. Cases involving a brain injury are complex and require the skill of a knowledgeable lawyer to evaluate your case.
- Loss of Limb
Losing a limb such as an arm or leg or extremities such as a finger or toe can be devastating. Oftentimes a traumatic injury may require that the body part be amputated. Many reasons can cause this type of trauma such as a motor vehicle accident, a workplace accident, or lack of proper medical attention. In addition to the psychological and physical difficulties of coping with the loss of a body part, you may also experience a strange sensation known as phantom pain whereby you experience sensations in the body part that has been severed from the body.
- Auto Accident
Every day thousands of people get in their automobiles to drive to work, run errands, travel, and a wide variety of other reasons. With so many people on the road, the fact is that someone is going to be involved in an automobile accident. Speeding, talking on their cell phone, ignoring posted traffic signs, or driving under the influence are all causes of accidents. When a driver is negligent and causes an accident, they will be liable in tort for compensating the victim of their wrongdoing, and in cases where drunk driving causes an accident, the victim may be able to recover punitive damages in addition to compensatory damages.
- Cruise Line Litigation
Cruise line customers report that New Orleans is their favorite port of embarkation because they get two vacations in one: first, a visit to the Big Easy and then, a trip on the high seas. New Orleans is a major port of call for Caribbean cruises, with 7-day Western Caribbean cruises currently being the most popular cruise package, industry-wide.
- Landlord/Tenant
At Bloom Legal we are prepared to help our clients with landlord/tenant issues in New Orleans, Metairie, Gretna, Harvey, and the surrounding areas. If you have problems on either side, from evictions to breaches of a lease, we can help negotiate the law and get you the fair results that both parties deserve.
- Notary Services
A notary public is a public official appointed by a state government to serve the public as an impartial witness. We have one on staff to provide any notary services that you may need. Contact us today for more information by giving us a call or filling out the form located on the left of the website.
- Mortgage Foreclosure Prevention
We understand how emotionally difficult it is to be facing a foreclosure situation, and how hurtful dealing with creditors can be. Bloom Legal stands with you and your family through this difficult time. Bloom Legal foreclosure prevention attorneys may be able to re-negotiate your payments or set up a workout plan. Bloom Legal foreclosure attorneys may be able to stop the bank from foreclosing on your home even at the last minute.
- Insurance Law
Insurance law is the specific practice of law that deals with any matter associated with insurance such as regulations, policies, and claims.
Rules and regulations that apply to insurance companies and the way these companies conduct their business is one type of insurance law. The other is how insurance companies handle claims for losses by their insured clients.
- Hurricane
Hurricanes Gustav and Ike have caused severe losses and damages to many family’s homes, businesses, and personal property throughout Louisiana, including Baton Rouge, Houma, Lafourche, Thibodeaux, and Morgan City, as well as throughout Texas, including Houston, Galveston, and Beaumont. It has been estimated that Texas and Louisiana suffered over 12.4 billion dollars worth of damage.
- Oil Spill Litigation
On April 20th, 2010, a massive explosion aboard BP’s Deepwater Horizon rig, located 41 miles off the Louisiana coast, triggered a series of events that have cost the Gulf Coast region of the U.S. dearly. The explosion not only sank the rig and killed 11 workers, but it also triggered a sea floor oil gusher that has led to what is now the largest offshore oil spill in U.S. history.
