How To Split Debt In A Divorce

Basically, each person will, either in their petition or their response, lay out what they believe is community debt, or separate debt. Basically, they try and come to an agreement before it goes to a hearing-type situation. It's really situational as far as debt goes. It depends on what was procured during the marriage, what each party is willing to take separately, coming to an agreement. And if the parties can't come to an agreement, it comes to a point where the judge will decide on what was procured by each party, and divide it, usually equitably, between the parties.

The Difference Between A Chapter 7 and Chapter 13 Bankruptcy

Chapter 7 and Chapter 13 Bankruptcy are different. First of all, because they deal with different parts of the Bankruptcy Code. In Chapter 7 Bankruptcy, a trustee is appointed to oversee your case, gather all your assets and liquidating those assets, if needed. However, with the majority of cases that we see, no assets are actually liquidated and you don't lose any of your property. In a Chapter 13 case, the trustee creates a payment plan, where you'll repay your creditors a certain portion of the debt that they were owed within a spread and span of three to five years.

If someone was to fall behind on their child support or spousal maintenance, what we could do is we would usually file a petition to enforce the child support or spousal maintenance. If they are behind, it goes into what's called arrearages, and they're required to pay those as well. If someone is extremely behind in child support and spousal maintenance, it can result in incarceration. If we do a petition to enforce the child support, we can have wages garnished, incarceration is often put into place, and we can get those funds back for what is due.

What Is A Means Test?

What Is A Non-Contested Divorce in Arizona

The quickest process to get a divorce done is what's called a consent decree. Basically, that's a non-contested divorce, everyone agrees on absolutely everything. Basically, you would still file a petition in response. But both parties would, at that point, sign what's called a 'consent decree'. The consent decree is filed 60-days after the petition is filed and it takes about a week with the judge to be approved after the consent decree is filed, and the whole process takes about two months. And that's the quickest process to get a divorce. Any contested divorces can take anywhere from seven months to a couple of years, depending on the parties' disagreements.

What Is A Petition To Modify Child Custody?

Basically, if you already have a custody order put into place where you have visitation, we can file what's called a Petition to Modify the Custody. We can ask for you to have more visitation, we can ask for the custody to be changed from primary custody to joint custody. There's a lot we can do at that point regarding getting you either unsupervised visitation, a difference in legal decision making, or basically just completely modifying the custody agreement at that point.

What Is A Preliminary Injunction?

During the divorce process where we file with the court, we file what's called a Preliminary Injunction. This prohibits either party from leaving the state with the minor child. What Is a Reaffirmation Agreement

What Is An Emergency Child Custody Temporary Order?

Basically an emergency temporary order is if there's a situation where a parent is not being able to see the minor child, or the minor child is in a dangerous situation that could compromise his safety, we could ask for an Emergency Temporary Orders hearing. This could be with or without the other party's notice, depending on the seriousness of the matter. And this would ask for a very quick hearing in front of the judge to either get parent time with the minor child, or get the child out of the situation that is dangerous for him. A Chapter 7 bankruptcy does allow you to keep your house and your car. A Chapter 7 only wipes away unsecured debt, so automobiles and homes are secured debts. Therefore, a Chapter 7 won't wipe away any of those loans that you have. However, you can sign a Reaffirmation Agreement to keep your car, which a Reaffirmation Agreement is essentially a new contract you make with your car finance company that will survive the bankruptcy. Therefore, cars and homes are not wiped away in a Chapter 7 and you can keep those even when you file for Chapter 7 bankruptcy.

If your looking to file bankruptcy by yourself, without an attorney, there is a number of different locations where you can find the correct paperwork.

The first is to go to the U.S. Trustee's website which is at trustees.gov.

Another is to go to an actual bankruptcy court itself. In the State of Arizona there are two bankruptcy courts. There is a bankruptcy court in Tucson and there is a bankruptcy court in Phoenix.You will then ask for the Clerk of the Court and ask for forms to fill out to file a chapter 7 bankruptcy.

Your wife would be entitled to half of what incurred during your marriage. If your 401k had begun prior to the marriage, anything incurred prior to your marriage is separate, and that is your property. Anything incurred during the marriage, she is entitled to half of.
