- Trademarks

Our attorneys have filed hundreds of trademark applications with the United States Patent and Trademark Office and in addition to foreign trademark applications. There are many considerations prior to filing that our attorney's will discuss. Just some of the issues that we discuss involved clearance of the trademark, the goods and services, whether the application will be filed on a use or intent to use basis, design mark vs. word mark, collective marks. These are just some of the issues that may arise.

- Patents

If you have developed an invention and seek to protect it, you need an experienced patent attorney licensed with the state and registered with the United States Patent and Trademark Office ("USPTO") who can guide you through the patenting process. Your application will either be a Utility, Design, Plant, or Provisional Application. During our consultation, we will advise you as to which type of application is appropriate for your invention. - Copyrights

The authority for copyright protection can be found in United States Code Title 17. It provides to the authors of "original works of authorship," including literary, dramatic, musical, artistic, and certain other intellectual works. Protection is available for both published and unpublished works. Under Section 106 of the 1976 Copyright Act, the owner of copyright has the exclusive right to do and to authorize others to do the following:

• To reproduce the work
• To prepare derivative works based upon the work
• To distribute copies or phonorecords of the work to the public by sale or other transfer of ownership, or by rental, lease, or lending; the work in copies or phonorecords
• To perform the work publicly, and in the case of literary, musical, dramatic, and choreographic works, pantomimes, and motion pictures and other audiovisual works
• To display the copyrighted work publicly, in the case of literary, musical, dramatic, and choreographic works, pantomimes, and pictorial, graphic, or sculptural works, including the individual images of a motion picture or other audiovisual work
• In the case of sound recordings, to perform the work publicly by means of a digital audio transmission

- Domain Name Escrow Service

Our firm facilitates domain name transfers by acting as the third party escrow to insure the domain transfer occurs without fraud. Typically, the funds used to purchase the domain name will be transferred to a special account of our firm to be held in trust. We hold the funds until we receive the authorization code from the seller of the domain. As such, both parties can rest assured that they received the domain and the funds without the occurrence of fraud.
