Davies Abogados entered from very early on into a vicious circle of handling inheritance cases for expats, which led us to become experts in the field which in turn provoked more clients and other solicitors recommending us for this kind of work. The tax implications of a Spanish inheritance are very complex, and serious mistakes can be made if your work is not handled by an expert. Inheritance tax levels are set by the state, but then each comunidad automona (areas of Spain) has established reductions, exemptions applicable to certain heirs and circumstances. Inheritance tax is calculated by self-assessment. If you pay the tax man too much, you will probably never find out. We can handle inheritance work correctly in any Comunidad Automona in Spain and will make sure that the tax is calculated correctly making use of any exemption or reduction available.

- Ending Joint Ownership
If you own a property/ies jointly with other people and you have decided that you no longer wish to maintain the joint ownership, we can force the issue, allowing you to either purchase the other share, they purchase your share, or the property sold and the moneys divided. Our experience shows that as soon as the other party realizes that we can indeed force the issue using the courts, they tend to agree to settle the case, very often in favourable conditions to our clients.

If you have purchased a house and do not yet have all your paperwork in order, we will sit down with you and propose the best way forward.
- Property Litigation
Do you want to claim your deposits back from your builder? Has your developer not built the urbanization that they had promised on their publicity after signing deeds on your property? Have you purchased a property and then found hidden defects not evident when you purchased? Has your stepmother/stepfather inherited your mothers/father´s property in Spain? You may have a claim against the estate.
We will look into your case and try to reach an out of court settlement with the other party using the courts as last resource. Often the other party will be more prone to a settlement after the case has been initiated. We will be very clear in explaining the possible outcomes of the court case and if possible best and worst case scenarios. We will not be pushing you into a court case we do not believe in, or let you hire us if your expectations are not in line with what we feel can realistically be achieved.
