The Di Bartolomeo Law Office is an Astoria, Oregon law firm helping families in the Columbia Pacific region and Oregon's North Coast with personal injury and wrongful death claims, on the job injuries, and Social Security disability claims. Joe Di Bartolomeo offers over twenty year's experience helping clients navigate through the challenges of overcoming a serious injury, and facing an aggressive defense.
This experience is varied, including helping clients involved in serious logging and construction accidents, motor vehicle and log truck collisions, and catastrophic on the job injuries. Joe has also helped families through the difficult process of a wrongful death claim. Joe has tried several cases to verdict in Oregon Courts, and has argued several cases in front of the Oregon Court of Appeals, the Oregon Supreme Court, and the US Ninth Circuit Court of Appeals.
In the Social Security Disability arena, Joe has represented literally hundreds of disabled workers at the hearings level and before the Social Security Appeals Council. He and his staff work closely with clients, and their health care providers to document a client's barriers to work.
Joe also takes great pride in his work representing injured workers before the Oregon Workers Compensation Board, having tried several workers' compensation claims, and assisting injured workers in exploring alternative dispute resolution of their workers' compensation claims.
Joe is also actively involved in his community. Joe takes great pride in his work as a volunteer attorney in representing two families before the September 11th Victim's Compensation Fund, traveling back to his home state of New Jersey on several occasions to meet with his clients, and appear before the Victims Compensation Fund.
Joe also helped in establishing the Astoria Children's Museum, as well as the Astoria School Foundation. The Di Bartolomeo Law Office has also sponsored several youth sports programs in the Astoria and Warrenton area, and is a strong supporter of local children's 4 H projects.

Areas of Law Description
- Personal Injury
The following are the different kinds of personal injury cases we handle:
*Car Wrecks
Car wrecks are too common, and a major cause of injuries. A wreck can be minor, or catastrophic, resulting in traumatic brain injury, and even death. Sometimes, what seems like a minor injury can develop into a chronic, long-term problem. We represent people injured in car wrecks, truck accidents, and motorcycle accidents. We have handled many cases over the years, from the minor fender bender to serious injuries, including traumatic brain injury and spinal cord injuries. Even if you are not sure how badly an accident injured you, call us to set up a free consultation. We can explain how these claims work, so you at least know where you stand.
*Slip and Fall or “Premises Liability”
Many slip and fall injuries result from defective and dangerous conditions property owners negligently maintain or fail to repair. These include defective stairways, walkways, railings and many other premises defects and conditions. If you've been injured as a result of a dangerous condition on property owned by another person or business, you face many challenges. This includes: dealing with insurance companies, doctors and hospitals; missing work; loss of income; mounds of paperwork – and trying to get a fair settlement! The most challenging issue of all, however, is proving that the owner was negligent. Many property owners will claim that they did not know about a defect, or that the defect was out in the open, so you should have known about it, so it’s your fault.
*Construction Accidents/Logging Accidents
Workers injured on the job are generally covered by workers compensation, but in many cases, they may have a separate claim against the person or company causing their injuries. For example, when a negligent driver hits a police officer, the police officer has a workers' compensation claim against his employer, and a separate case against the bad driver. This is sometimes called a “third party claim.” In Oregon, if a construction worker or a logger is working on a project involving other contractors or subcontractors, the injured worker may have a claim if one of the other contractors was careless in running the work site. This is because of a statute called the Employer Liability Law. This is a specialized area of the law. Our law office has helped injured construction workers, truck drivers and loggers pursue these claims, often allowing for recovery greater than what is provided under the workers’ compensation laws.
- Social Security Disability Claims
Our office has extensive experience representing Claimants in front of the Social Security Administration. Joe Di Bartolomeo is a member of the National Organization of Social Security Representatives, and has handled hundreds of cases in front of Social Security Administrative Law Judges and the Appeals Council. He also works closely with other lawyers who handle cases in the United States District Court and 9th Circuit Court of Appeals. You can confer with Joe without charge, and find out where you stand with your claim.
- Workers' Compensation Denials
At first glance, workers’ compensation appears to be straight forward. If you are hurt on the job, your employer or its insurance company provides you medical benefits and lost wage benefits. You get better, and you go back to work. But it’s not that simple. There are complex regulations that can fill many bookshelves, Bulletins, Board Cases, Contested Case Orders, and several offices in the Workers’ Compensation agencies. Sometimes, getting a prescription filled, or a time loss check can be a major project.
- Wills, Trusts, And Estate Planning
Many people who visit our office to plan their estate confess that they have been putting it off for too long. There are a lot of reasons. However, after an initial conference, the documents are prepared, and after every thing is signed and sealed, clients achieve a peace of mind. We offer affordable, common sense estate planning to put you at ease, and protect your loved ones.
