- Health Care Fraud
Examples of health care fraud include: False billing for medical services or drugs not provided; Fraudulently billing insurers for appointments that were not made or were cancelled in advance; Inflating the charges for services or drugs; Charging brand name price for generic drugs and medical products, and, Diluting drugs so the patient does not receive what was ordered.
- Insurance Provider Fraud
We hear in the news about people defrauding insurance companies with false claims and fake injuries. We seldom hear about fraud that insurance companies or their agents commit against the public — but it happens. The federal False Claims Act and California Qui Tam laws cover whistleblowers who are uncovering fraud against the government, but individuals can be defrauded too. In the case of insurance company wrongdoing, its fraud committed against policy holders by the insurance company when they wrongfully deny valid claims.
- Military / Defense Contractor Fraud
California is home to 27 active military installations, as well as hundreds of military / defense contractors and suppliers. The Coast Guard, Marines, Navy, Army, Air Force, and Reserves maintain facilities in or near San Diego, Barstow, Oceanside, El Centro, Lemoore, Monterey, Oxnard, Marysville, Lancaster, Fairfield, Lompoc, Los Angeles, Herlong, Alameda, San Francisco, and Petaluma. Defense Contractor Fraud includes: Charging for goods and services not delivered; Payroll Fraud; False billing of hours worked; Over charging for goods & services provided; Substandard, unsafe vehicles; Substandard supplies and food products; Inferior tools, inferior clothing, inferior safety gear; and, Poor performance of support duties.
- Construction Contracts / Public Works
Public works fraud can include: Improper or unsafe construction techniques (such as the improper mixture of concrete, failing to use the right kind of rebar or reinforcing steel) can lead to building failure, bridge collapse, or accelerated decay; Failure to vibrate concrete can result in air bubbles that weaken a structure; Falsifying the data of a core sample that shows whether materials are properly hardened can hide structural problems; and, Faulty electrical work or plumbing, or improper installation of fire safety systems can result in damage to the building, to workers, and to the public.
- Mortgage & Loan Fraud
In the area of mortgage and loan fraud, there are three types of problems. One affects the government, and the other two are forms of consumer fraud: 1. Falsifying loan documents in order to obtain money: this is a fraud committed against lenders, including government backers of loans; 2. Loan fraud committed by lenders who unlawfully refuse to provide loans in certain parts of the community (redlining of minority communities) or to certain types of lenders based on unlawful characteristics (such as race, sexual orientation or marital status); and, 3. Reverse mortgages scams that offer rates or terms that are grossly unfair to the person who took out the reverse mortgage.
- Tax Fraud
Tax fraud can be against the federal, state or local government. Some examples include: Falsification of capital improvements; Failing to correctly report capital gains; Claiming excessive depreciation; Writing off private expenses as if they are company expenses; Falsely reporting of food and entertainment expenses for business purposes (client development expenses) rather than personal purposes; Underreporting of income and over-reporting of deductible expenses on Schedule Cs; and, Failure to pay sales taxes.
- Unsafe Foods & Consumer Products
Our attorneys can handle a wide range of consumer safety cases, including: Mislabeling a food product as nut or allergen free when it is processed in a plant where nuts are present; Mislabeling a food product with a false expiration dates; Improperly identifying contents on a product, stating something is U.S.DA grade A when it is not; Falsifying information about whether a product is suitable for diabetics or contains sugar; and, False labeling of a product as kosher, vegan or organic when they fail to meet certification requirements for that kind of labeling.
