If you are divorcing in Edmond, either you or your spouse must be a resident of Oklahoma for at least six months immediately prior to filing for a divorce. Filing for divorce can be done in the county in which the filing spouse has been a resident for 30 days or in the county where the nonfiling spouse resides.
A legal separation provides the framework necessary for the division of assets and debts, support alimony, child custody and visitation definitions and property division. Sometimes, a separation agreement is a transition device, which means that a legal separation can become a full divorce or dissolution of marriage action at the discretion of either or both parties.
- Child Custody
When parents are divorcing, an important issue that takes time and thought is child custody in Oklahoma City. A court may order joint or sole custody based on the best interests of the child and the court will also give consideration to the preference of the child. There is no presumption for or against joint or sole custody in Oklahoma City. Custody or visitation with a child will not be granted if it is established that it will expose the child to a risk of harm.
