Areas of Law Description
The scope of our practice includes:
- Auto Accidents
James F. Ludlow, Attorney at Law PC handles cases of serious injury that are caused by a car accident. Injuries that are common in an auto accident include:
• Brain and spinal cord injuries
• Knee injuries, such as torn ligaments
• Neck and back injuries
• Broken bones
• Herniated discs
• Post-traumatic carpal tunnel syndrome
• Facet joint injuries
• Shoulder injuries, such as rotator cuff tears
- Aviation Accidents
Aviation accidents involving private aircraft are a far more frequent occurrence than commercial aircraft accidents. Many private aircraft have electronic weather and navigation systems that until recently were only found on commercial aircraft such as a Boeing or Airbus jetliner. While these avionics can be very helpful, it also can create a false sense of security for an inexperienced pilot, often with tragic consequences for the pilot or their passengers. In addition, air traffic controllers may sometimes provide inadequate weather information to a private pilot, thus resulting in an accident that could have been avoided. Defective maintenance of private aircraft by a contractor is also a frequent cause of accidents.
- Bicycle Accidents
In many cases, a bicycle accident is caused by a motorist’s negligence or inattentiveness. My firm is dedicated to quickly investigate your bicycle accident claim, evaluate the severity of your injuries, and make sure that you receive fair and reasonable compensation as soon as possible so that you can get on with your life. To accomplish this goal, I usually have an experienced investigator visit and photograph the accident scene, photograph the vehicle and bicycle that were involved, and take statements from any witnesses to the accident. Because orthopaedic or neurological injuries are common in this type of accident, I also usually meet with the client’s treating physician(s) to discuss the nature and extent of the client’s injury.
- Boating Accidents
I have represented many people who have been seriously injured while boating, skiing, or using a personal water craft such as a Jet Ski or Wave Runner. As an avid wake boarder, boater, and jet skier myself, I am familiar with the laws and regulations that apply to these activities, and how these accidents can occur.
- Brain and Spinal Cord Injuries
James F. Ludlow Attorney At Law is dedicated to helping the families of people who have suffered a serious brain or spinal cord injury. If you or a loved one sustained a brain or spinal cord injury as a result of someone else’s negligence, my goal is to see that you receive just compensation for your injuries.
- Burn and Explosion Injuries
If you or a loved one faces painful recovery or disfigurement because of a burn that was caused by someone else’s negligence, I can help. I have worked on many types of burn injury cases, including:
• Hot water burns from scalding water
• Burns from a defective product
• Burns from an improperly used product
• Burns from a workplace explosion accident
• Burns from a chemical explosion
• Gasoline burns
- Catastrophic Injury Claims
Types of Injuries that could be considered catastrophic include the following:
• Serious Head Trauma
• Eye Injury with blindness or significant vision impairment
• Nerve Injury to neck, arm or leg
• Brain Injury
• Spinal Cord Injury
• Severe Burns
• Accidental Amputation
• Multiple Bone Fractures
- Construction Site Accidents
Construction site accidents are often complex, since employees from several different companies are often working in one area. I thoroughly investigate the details of the construction site accident to determine if a subcontractor, manufacturer of a product, or a general contractor is legally responsible for the accident. I strive to understand how your injury affects you as an individual and how the injury will affect your future.
- Dog Bites
In Indiana, pet owners have a legal obligation to use reasonable care to control their dogs. Interestingly, Indiana law also provides for strict liability on behalf of a dog’s owner if a postal worker is bitten while working. In most cases, the homeowners insurance policy of the dog’s owners pays damages for dog bite injuries. If you or a loved one has suffered serious injuries due to a dog bite or attack in Indiana, you need the assistance of the aggressive and experienced attorney. Contact James Ludlow who brings over 22 years experience in representing personal injury clients.
- Motorcycle Accidents
James Ludlow is dedicated to serving the interests of injured motorcyclists in Indiana and throughout the Midwest. For more than two decades, I have helped injured clients after they were seriously injured in a motorcycle accident. I understand how serious injuries affect people physically, emotionally, and financially, both now and in the future. I have experience in handling claims with many types of injuries, such as:
• Brain injuries, such as traumatic brain injury (TBI)
• Road rash and other burns
• Head and neck injuries
• Broken bones
• Hand, foot, knee, and shoulder injuries
- Nursing Home Negligence
The law firm of James F. Ludlow, Attorney at Law, P.C., helps families hold nursing home staff and supervisors responsible for any neglect or negligence that affects a patient or resident. With more than 20 years of experience in personal injury claims, I work with families to pursue just compensation from nurses, administrators, owners and other nursing home personnel.
Our elderly loved ones deserve to be treated well in their last years. Their health and bodies are often fragile and need special care. Because their balance and strength may be compromised, falls and injuries are more likely in the absence of adequate care and support from a well-trained staff.
- Pedestrian Injuries
The primary cause of pedestrian accidents is driver negligence. These accidents can occur when drivers:
• Fail to yield the right of way
• Back out of parking spaces
• Speed in residential areas
• Fail to stop at stop lights and signs
• Turn right on red without looking for pedestrians
• Drive recklessly
• Drive while intoxicated
Pedestrian accidents can result in serious injuries including head injuries, traumatic brain injury, spinal cord injury, burn injury, amputation injuries, back and neck injuries, multiple fractures (broken bones) requiring surgical repair, other serious injuries and death in some cases. Injuries may require extensive time and rehabilitation to heal, and some injuries may recur in the future.
- Railroad Accidents
Attorney James Ludlow represents people who have been injured as a result of train accidents, train collisions, train derailments, and train crashes in Indiana. Train accidents often occur because of derailment, driver negligence, collision with a car or bus, collision with another train, mechanical failure, unprotected crossings and poor track maintenance.
- Semi Truck Accidents
I provide prompt service and investigation of your truck accident. This includes getting a full understanding of how the accident occurred. In addition to interviewing witnesses to the accident, the onboard data recorder that most semi-trucks now carry can provide valuable information about how fast the truck was going when it hit your car or motorcycle. The truck driver’s log books and other records such as fuel receipts and maintenance records can also show whether the driver followed federal trucking regulations for driving hours. In fact, various studies have shown that about two-thirds of truck drivers report problems with fatigue while driving.
- Slip and Fall Accidents
If you slipped and fell because a store or other property was not kept in a safe condition, I can help you seek just compensation for your injuries. Since 1989, I have helped injured people with personal injury claims that are caused by slip and fall accidents. A slip and fall may be embarrassing at the time, but injuries that may occur in such accidents can be serious and cause long-term hardship. My firm has represented personal injury clients throughout Indiana who were injured due to a variety of causes, such as icy sidewalks where no salt or sand was applied by the property owner, wet floors, or even defective store displays that fell on store patrons.
- Wrongful Death Claims
I have successfully handled wrongful death claims for families throughout Indiana. In our State, there are four basic types of wrongful death claims that Indiana courts recognize. First, there is a claim for the death of a parent that may be brought by their surviving children. Second, there is a claim for the death of a husband or wife by the surviving spouse. Third, there is claim for the death of a child by the surviving parents. Lastly, there is a wrongful death claim for an unmarried individual who was an adult when they died, but had no dependents. Since these claims are complex and often have a substantial value, working with an attorney who has experience with wrongful death claims is very important.
