Areas of Law Description
Law Office of John A. Caputo's areas of practice include all serious or catastrophic injuries and death, including:
- Car and Truck Accidents
If you have been injured in an automobile accident, we can file a lawsuit against the person who caused the accident to obtain an award of damages. In an auto accident injury suit, we must prove that the driver of the other vehicle caused the crash by not paying attention or not taking reasonable care. Receiving an award depends on what the other person should have anticipated at the time of the accident.
- Construction and Industrial Accidents
Construction sites and industrial locations such as mines and manufacturing plants are among the most dangerous places you can work. Unsafe conditions, error by a heavy equipment operator, defective machinery, or negligence by a property owner or equipment manufacturer can cause devastating injuries or death.
- Medical Malpractice
Attorney John A. Caputo offers skilled legal support for victims of medical malpractice. He is prepared to represent you in any type of case in which medical negligence played a role in your injury. These cases have included injuries or deaths from medical carelessness or surgical errors.
- Premises and Property Liability
When you have been hurt because of the negligence or recklessness of a property owner, you may get compensation for your injuries from them. In order to collect on an injury claim in Pennsylvania, you must prove that the property owner or other responsible party failed to exercise reasonable care to prevent the injury by showing that certain conditions apply.
- Products Liability
Mr. Caputo has successfully represented individuals who have suffered serious harm—including brain injuries, cognitive impairment, and severe disabilities—as a result of the use of defective or misrepresented products or medical equipment. Home accidents involving ladders, saws, power tools, appliances, and lawn tractors also produce valid liability claims.
- Natural Gas Rights and Claims
Western Pennsylvania is the site of large deposits of natural gas in what is known as the Marcellus Shale layer, which lies a few thousand feet below the surface. This makes tracts of land over the rich deposits and mineral rights very valuable. The rural landowners who own sizable tracts of land or mineral rights are inundated with requests from energy companies to either buy or lease the gas rights.
- Third-Party Liability
In Pennsylvania—due to the workers compensation laws—you cannot sue your employer for an injury resulting from a workplace incident. However, if you were injured through the negligence of someone other than your employer or a coworker, you may have a third-party liability case.
- Birth Injury
Mental and motor delays in development or cerebral palsy may occur as the result of preventable injuries to the brain in the birthing process or immediately after delivery. For example, a lack of sufficient oxygen to the brain at this time can result in permanent brain damage.
- Brain Injury
There are times when medical professionals or hospital caregivers do not follow the well-known, accepted practices that would detect conditions that threaten the brain. Failure to investigate or even a slight delay in investigating symptoms can lead to irreversible brain injury that incapacitates the patient.
- Cancer Misdiagnosis
Advances in medicine allow high cure rates in many types of cancer, provided they are detected and treated at an early stage. Unfortunately, many cases are not diagnosed or treated until it is too late. Sometimes doctors or other medical personnel fail to order a test or investigate when presented with signs and symptoms suggesting the possibility of cancer.
- Cerebral Palsy
The brain of a fetus or neonate can suffer many types of difficult insults. One such preventable insult is perinatal asphyxia—lack of sufficient oxygen delivered to the fetus in the uterus during labor. Prolonged oxygen deprivation permanently injures the brain tissues.
- Brain Injuries
Brain injuries can occur in many different ways. Trauma can cause a brain injury. Some of these are the result of carelessness, causing direct traumatic contact to the brain by an outside object or force. Others are caused by the brain literally striking the inside of the skull.
- Closed Head Injury
Closed head injuries can result in hydrocephalus—fluid collection, hemorrhage—bleeding of the tissues, and sometimes herniation of the brain—the destructive movement of the brain from the force of the fluid or blood collection.
The brain may be injured very seriously without a fluid or blood collection. A serious concussion or bruise of the brain can injure its connecting fibers and hamper its ability to transmit signals. This can cause cognitive changes including loss or deterioration of memory, difficulty in thinking and reasoning, and speech and learning disabilities.
- Anoxia and Hypoxia
A problem with breathing as the result of an arrest, shock, stroke, or deficiency in the lung—whereby blood is not oxygenated sufficiently—can cause temporary anoxia (lack of oxygen) or persistent hypoxia (lowered amount of oxygen in the brain). These conditions damage brain tissue and result in severe motor and mental function deficits.
