Areas of Law
Areas of Law Description
- Chapter 7 Bankruptcy
Your Chapter 7 bankruptcy lawyer should thoroughly inform you of your options so that you feel comfortable with whatever decision you make. Filing personal bankruptcy is never an easy choice. Lee Legal will make the process as painless as possible and advance your case expeditiously. Chapter 7 bankruptcy may be a good option if your income makes it difficult or impossible to pay your debts. In a Chapter 7 bankruptcy, you will not have to repay your debts. Instead, all of your eligible debts are simply eliminated (or “discharged”) and you get a fresh start.
- Chapter 13 Bankruptcy
An experienced Chapter 13 bankruptcy attorney will work closely with you to ensure the success of your repayment plan. Chapter 13 offers immediate protection from all collection efforts, including phone calls, lawsuits, garnishments, vehicle repossession, and foreclosure. The experienced Chapter 13 attorneys at Lee Legal will work closely with you to develop a repayment plan. In many cases, we can structure a plan in which you will repay only a fraction of your unsecured debts.
- Chapter 11 Bankruptcy
Even a very successful business can become overextended. Your business may be well managed, have good cash flow and a great business model. Yet one impatient investor or vendor or stubborn landlord can threaten the health of your business. If your business is unable to keep up with payments or is taking on more debt, Chapter 11 may be a good option for you. In many cases, filing for Chapter 11 bankruptcy protection may be the only way to save your business.
- Chapter 12 Bankruptcy
Chapter 12 bankruptcy was created for a very specific group of debtors: family farmers and fisherman. Chapter 12 is a form of reorganization, which allows farmers and fisherman with a steady stream of annual income to pay back all or a portion of their debts over an extended period of time. Chapter 12 is often used to finance significant debts due to equipment purchases or facility upgrades. Chapter 12 bankruptcies are uncommon in the immediate D.C. area, but happens with some frequency in western and southern Virginia.
- Foreclosure
If you want to stop foreclosure in Virginia or Washington, D.C., you must act quickly to protect your rights. If you have missed mortgage payments and a foreclosure auction has been scheduled, your lender will not stop the foreclosure process until the sale of your home is complete.
- Debt Settlement
If a credit card company or collection agent is pursuing you on a loan or debt, the experienced debt negotiation lawyers at Lee Legal will start taking the calls and aggressively attempt debt reduction of your bills. Lee Legal will work closely with you to determine whether litigation, debt consolidation, debt management, or debt negotiation is the best strategy for you. Once you have retained us, your creditor must route all calls and correspondence through our office.
- Car Repossession
If you default on your car payments, your car finance company will take the necessary steps to repossess your car. Typically, the company can repossess your car without going to court and without providing you with advance warning. Lee Legal is the law firm of Brian V. Lee, a bankruptcy lawyer in DC who can assist you if you are facing repossession. Filing for bankruptcy in DC or VA automatically prevents your creditors from taking certain actions against you, including repossession.
- Student Loans
Student loans cannot easily be discharged through bankruptcy. If you are considering filing for bankruptcy in the Washington, D.C. area, you should know that certain types of debt are generally nondischargeable, which means that your bankruptcy discharge will not affect the debt at all. Like most federal and state taxes, child support and alimony, or criminal restitution and fines, student loans will survive the bankruptcy process and will be as valid and collectable as they were prior to the bankruptcy.
- Deed in Lieu
A Deed in Lieu of Foreclosure is a way to transfer ownership of a home to the mortgage company and avoid foreclosure. A Deed in Lieu is the legal conveyance of all interest in a real property by the mortgagor/borrower to the mortgagee/lender, in exchange for forgiveness of the defaulted mortgage. The Deed in Lieu is a way for both the borrower and lender to avoid costly and potentially lengthy foreclosure proceedings.
- Garnishment
Garnishment (or “attachment”) is a last-ditch effort at debt collection, a tool of last resort for creditors. When you default on a debt, and the creditor is unsuccessful in recovering on the debt, a judgment may be issued against you to garnish property, bank accounts, or wages. Garnishment can often severely impact your monthly finances, and garnishment reflects very negatively on your credit score and credit report.
