Law Firm Overview Free ConsultationFREE CONSULTATION

Liviakis Law Firm is located in Sacramento, California. We serve clients in the areas of bankruptcy and estate planning.
Noted, Sacramento has seen a significant increase in the number of law firms offering personal bankruptcy services for individuals and families since the start of the recession in 2007. Bankruptcy is often the best solution for people who need to start over from the crushing burden of personal debt resulting from a job loss or the increasing cost of living in Northern California.

At the Liviakis Law Firm, I offer debt relief and estate planning services for individuals, families and business owners who are facing staggering and complex debt problems. I believe that starting over isn't enough. The idea of just starting over from debt is what leads many people to travel down the same road to debt, resulting in a fair percentage of people who file a second time.

The Liviakis Law Firm has quickly earned recognition among satisfied clients, creditors and bankruptcy court trustees for finding honest, intelligent strategies to help clients find solutions that many other law firms don't look for. There is nothing more important to my career than maintaining a sense of integrity in my work ethic and pride in the results I obtain for clients.

Areas of Law Description

Liviakis Law Firm serves clients in the following areas of practice:

- Creditor Harassment

Under state and federal laws, creditors are restricted in their collections activities. The federal Fair Debt Collection Practices Act (FDCPA) makes it illegal for creditors to engage in threatening, offensive or intimidating behavior against any individual debtor from whom they are trying to collect on a bill owed.

- Chapter 7 Bankruptcy

As well as eliminating much of your debt, filing Chapter 7 also has the advantage of placing an automatic stay of execution on any collections actions your creditors have in process against you. This includes stopping foreclosure proceedings, avoiding wage garnishments and preventing auto repossession.

- Tax Debt and Tax Workout Plans

Income tax debt can often be eliminated under Chapter 7 if you have filed your tax returns and sufficient time has passed since the tax debt was assessed. If you owe a substantial amount of federal or state tax debt, you may not need to file for bankruptcy. I can help you negotiate an offer in compromise that typically reduces your tax arrears substantially.

- Chapter 13 Debt Reorganization

Most people consider Chapter 13 to be a lesser form of bankruptcy, but it often has more advantages. Under a court-supervised Chapter 13 reorganization plan, you can include nearly all debt. I will work with your creditors to negotiate a plan that will generally reduce your interest rates and the principal of the loan.

- Divorce and Debt

If you are considering filing for divorce, it is important to remember that family debt is considered marital community property in California. It is often a good idea to eliminate as much debt as possible through bankruptcy, prior to beginning the divorce process.

- Chapter 11 Bankruptcy

Owning and operating a small business in Northern California means you put your financial life on the line every day. Even a minor downturn in business can result in juggling payments to creditors. Within months, your vendors can begin cutting off supplies, and creditors can start squeezing you for money you don't have.

- Loan Modification

The threat of losing your home to foreclosure is among the most difficult and stressful aspects of having debt problems. Especially for those people who have two or more mortgages, it can seem impossible to get on top of what you owe. Fortunately, Chapter 13 bankruptcy provides the ability to strip a junior lien from your primary residence.

- Unsecured Second Mortgage

When a second mortgage is stripped from your residence, it is reclassified from secured to unsecured debt. As unsecured debt, the surplus value of the loan can be included as part of your Chapter 13 bankruptcy repayment plan, which allows you to pay just a portion of it over 36-60 months while continuing to make your primary mortgage payments.

- Missed Mortgage Payments

Chapter 13 debtors may stop foreclosure actions and catch up on their delinquent loans payments over time. The bankruptcy court can approve a payment plan that repays banks and mortgage companies slowly over time. Modifying a loan through the bankruptcy court is much different than applying for a loan modification directly through the bank.

- Junior Mortgage Modification

The bankruptcy lawyer you choose can have a large impact on the outcome of your case, and consequently, your financial outlook. Contact an office near you for a free initial phone consultation with a knowledgeable Sacramento and Folsom unsecured second mortgage lawyer who is ready to use his experience to help you achieve your financial goals.

- Debt Settlement

At Liviakis Law Firm, I work with clients who are interested in solving their debt problems with the help of a Sacramento attorney skilled at protecting your assets from creditors pressuring you to make monthly payments. I will thoroughly and clearly explain the debt settlement process and advice on how an out of court payment plan differs from bankruptcy.

- Real Estate Bankruptcy

The Liviakis Law Firm is ready to help resolve your commercial real estate investment firm's financial difficulties. My Sacramento law firm has a unique focus on guiding real estate corporations through Chapter 11 bankruptcy. To learn more about your options for debt relief, contact me, a Sacramento real estate bankruptcy attorney, for a free initial phone consultation.

- Chapter 12 Bankruptcy

Through filing for Chapter 12, a farmer has the opportunity to reduce the secured debt on his or her farm property, and to raise money to cover costs through post-petition financing. Lower interest rates are available after filing for Chapter 12 due to decreased risk for the bank in granting the loan, because these loans have the highest priority amongst all other debts.

- Foreclosure

If you have received word from your mortgage lender that you are facing foreclosure, there are steps you can take to stop the legal proceeding. I am debt relief attorney Mikalah Liviakis of the Liviakis Law Firm with offices in Folsom and Sacramento. Your first action to take after receiving a foreclosure warning is to call an experienced debt relief attorney.

- Debt Restructure

If you currently owe more money on a second home or vacation property than the declared property value, there are legal options available through Chapter 13 or Chapter 11 bankruptcy that allow you to restructure your mortgage to lower the principal balance. Your second mortgage on your principle residence may also be completely eliminated if your home's value has declined.

- Bankruptcy Property Sales

At Liviakis Law Firm, I work with clients who have complex debt problems and wish to build financial stability through use of the Bankruptcy Code. Whether residential or commercial property, Chapter 11 bankruptcy and Chapter 12 bankruptcy provide the opportunity to sell property in bankruptcy at a price that maximizes profit for business owners and farmers.

- Wills

The Liviakis Law Firm goes beyond debt relief and provides a full range of services to help you protect your financial future. The foundation of any effective estate preservation plan is a testamentary will. A will ensures that your assets go to the people you intend and will eliminate the need for probate court decisions that can result in emotional and costly litigation.

- Estate Planning

The Liviakis Law Firm provides a range of services to help you protect your individual and family assets from tax consequences following the death of an estate holder. As a debt relief lawyer who has helped clients across Northern California eliminate or reorganize their debt through Chapter 7 or Chapter 13 bankruptcy, I know that starting over from scratch isn't enough.

- Business Succession Planning

If you own a family business, I can help you ensure that your success remains in your family. Talk to me about business succession planning and other estate preservation and tax planning services for business owners.

- Elder Care and Social Benefits Planning

If you are looking for a way to protect your assets, or the estate of your elderly parents from the high cost of nursing home and long-term care, I can help you with a wide range of services, including Medicaid planning, Medicare planning and Social Security planning.

- Probate Law

I offer services for families who have lost a loved one in the Sacramento region. I handle all matters relating to probate law, estate administration and closing out the affairs of the deceased. I work with clients not local to central California, including those living out of state.
