Areas of Law Description
- Family Law
An experienced family law attorney can help you sort through the difficult decisions you must make and help protect you, as well as the best interests of your children, throughout the divorce process. Whether you are getting divorced or seeking custody of a child, the assistance of an experienced lawyer is crucial to finding a favorable resolution to your specific situation.
* Alimony
After the court identifies and distributes marital assets, it will determine the need for alimony. In the event that both parties have sufficient earning capacity or the property division is sufficient to keep the parties from becoming destitute, the alimony award is less likely. In Mississippi, disparity in the parties income is the single most common reason for an award of alimony.
* Child Custody
Child custody is the most litigious aspect of family law proceedings in Mississippi. Chancellors in Mississippi have authority to award custody of minor children in a variety of actions including initial divorce cases and in custody actions between unmarried parents and third parties. In addition, a chancellor awarding custody in one of these cases will have continuing jurisdiction to modify or enforce its order (through contempt proceedings).
* Child Support
In determining the appropriate amount of child support, the court first identifies a payor's gross income from all sources. As in most other jurisdictions, income from overtime and second jobs will be included in gross income in Mississippi if the work remains consistent and predictable. For example, a one-time bonus or teaching position may not be required to be included in gross income while a regular annual bonus or second teaching position may be included by the court in the definition of gross income.
* Visitation
Visitation is the time a child spends with a noncustodial parent. In Mississippi, a noncustodial parent has a right to continued significant contact with his or her child under circumstances that foster a close relationship. The court’s primary concern when determining how much visitation is proper balancing the best interests of the child coupled with the rights of the noncustodial parent.
* Divorce
Divorce can be one of the most painful and stressful experiences a person goes through in life. Many important decisions must be made in a short period of time that has the potential to impact the rest of your life, as well as the lives of your children. It is critical to avoid making hasty, misguided decisions when going through a divorce in Mississippi, especially when your children or property interests are involved.
- Criminal Law
Facing criminal charges can be a frightening and confusing experience. With so many potential consequences and a lasting impact on your future on the line, turning to an experienced lawyer for assistance combating the charges can be a vital step in limiting the damage caused by a conviction.
* DUI
Facing DUI charges in Mississippi can be a challenging and frightening experience. DUI offenders face mandatory license suspension, possible jail time, community service, drug and alcohol education programs, and steep fines. The social and personal consequences of a DUI can also greatly impact your life as you must deal with the increased insurance premiums, limited career options, and social stigma that are associated with a DUI conviction.
* Expungement
The arrest and conviction of a crime has a continuing negative effect on an individual’s record. For instance, employers and professional schools (i.e. medical, legal, accounting and nursing) all make decisions on whether to hire or admit a candidate, in part or in whole, on the basis of their criminal history. Moreover, a criminal history may prevent you from receiving a loan, leasing an apartment, holding a professional license, voting and even purchasing a firearm.
- Personal Injury
Determining how your financial obligations will be addressed after sustaining a serious injury can be a frightening and confusing task. If your injury occurred as a direct result of another individual's actions, you may be entitled to recover compensation for your losses, including any medical bills, lost wages, car repair and pain and suffering experienced as a result of your injury. During the process of recovering compensation, the assistance of an experienced lawyer can be crucial in finding a satisfactory settlement or court ruling in your favor.
