JOHN CALLAHAN: It doesn't really matter how long your license has been revoked, the main question for us is are you serious in trying to get back your license. We've had numerous clients come to us after they went to a formal hearing without an attorney, sometimes even with an attorney. If they're not prepared for all of the questions that they're going to hear at that hearing, the chance of success is significantly reduced and that's why they come to us.

This isn't like high school or college. If you get 70% or 90% of the answers right at this Secretary of State hearing you don't pass. If you're rejected you need to wait four months before you're eligible for another hearing again.

Before we go to any hearings, our clients have several sample hearings in our office so that we prep them on almost every single question they're going to face. If they get those questions right, they're going to have a very good chance of getting their license back.

JOHN CALLAHAN: If a commercial truck driver is found guilty of a DUI, their CDL can be disqualified for a year. Even if a person is not driving the commercial vehicle when they're pulled over for a DUI, they can still lose their CDL privileges if they're found guilty of a DUI. CDL holders have a zero tolerance policy when it comes to alcohol when they're driving their CDL vehicle. If a CDL driver blows over a 0.00, their CDL license will be disqualified for up to 12 months, especially if he blows over a 0.04 on that result. You have a very short period of time before your CDL is actually disqualified, 46 days from the date of arrest. Contacting an attorney right away is very important because they can take steps to contest the disqualification. We've typically been able to get DUI charges reduced down to reckless driving, where that client would not lose his CDL license. We're able to sometimes beat the statutory summary suspension, which then would nullify the CDL disqualification as well. If you don't do this and you don't have an aggressive defense, the CDL will be disqualified.

MICHAEL NORRIS: Don't believe the police. There are ways to avoid a suspension. There are ways to remove the suspension from your record. You just have to take competent legal steps to avoid this.

JOHN CALLAHAN: Class X is the largest classification in Illinois for felonies, meaning it's where the largest amount of drugs are found. It's also the strongest and most harsh sentence that a defendant can face. It's a minimum of six years in the Illinois Department of Corrections all the way up to 30 and then sometimes even more than that.

MICHAEL NORRIS: Probation is not an option in a class X felony. That being said, there's always an exception. It's like this law is eternal, except if you have a good lawyer. You can get class X felonies reduced to a felony that would allow you to get probation.

JOHN CALLAHAN: When you hire an attorney on a class X felony charge, your life is in his hands. You don't want somebody who's not going to look through the details and look at every single aspect of the case to try to beat it.

MICHAEL NORRIS: If you get charged with a DUI, your license to drive is going to be suspended in Illinois 46 days after you have been arrested.

JOHN CALLAHAN: There are two ways to beat the summary suspension that we've found. The first is beating it procedurally. And that's by filing the motions and putting a timeline up against the state that if they can't comply with, the client will not lose their license through suspension. The second is to actually go to a hearing.

MICHAEL NORRIS: If you get into court and a judge decides who he wants to believe, the police officer or the drunk, you're going to lose. You need to have an attorney file a document contesting the suspension of your driving privileges.

JOHN CALLAHAN: If the state does not give you a hearing within 30 days or the first court date of the filing of the petition to contest the suspension, they can't suspend the client's license. It's very important to try to beat the suspension because, if you're successful, A, the suspension goes completely off your record. And B, obviously, you can drive without any restrictions whatsoever.

MICHAEL NORRIS: If you become a target or you wind up in the crosshairs of the police on a murder charge, tell any police officer that you want to have an attorney and you do not want to talk to them. Their interest and your interests are not the same. There are a lot of criminal defense attorneys in Chicago. And there's a lot of good criminal defense attorneys in Chicago. Whether or not that person is competent to handle a murder case depends on the experience and the sophistication of that person. To be successful, you cannot have any fear. You have to believe that you're going to give your client the best defense that's available to him without any fear at all. Less experienced attorneys get nervous about this because the consequences of failing are extreme to your client. The fact that I have been certified to represent people in death penalty cases means that the Illinois Supreme Court has determined that I have the qualifications and experience necessary to represent people that have been charged with murder for which the ultimate sanction is available. That is your execution.

JOHN CALLAHAN: When your license is revoked for a DUI, typically, you'll have to go to a formal reinstatement facility to attempt to get your license back. At that hearing, you'll have to give testimony to a hearing officer. There will be a secretary of state attorney as well. And if you have an attorney, your attorney will guide you through the process. In some instances, we're able to bring our clients to an informal hearing. This typically happens when they only have one DUI arrest. It's typically an out-of-state DUI arrest while they have an Illinois driver's license. Once a client has done all of the classes and requirements in order to get a hearing, typically, they're eligible for a restricted driving permit right away. They are not eligible in most cases for a full reinstatement for one year. Obviously, a driver's license is a very important thing for a person to have. And it's very important to have an attorney when you go to these hearings because an experienced attorney will know the questions that are going to be asked at that hearing. More importantly, they'll know how to tell the client to answer those questions truthfully and consistently with what happened on the DUI and what the client told their evaluator.

JOHN CALLAHAN: It doesn't really matter how long your license has been revoked, the main question for us is are you serious in trying to get back your license. This isn't like high school or college. If you get 70% or 90% of the answers right at this Secretary of State hearing you don't pass. If you're rejected you need to wait four months before you're eligible for another hearing again.

JOHN CALLAHAN: Class X is the largest classification in Illinois for felonies, meaning it's where the largest amount of drugs are found. It's also the strongest and most harsh sentence that a defendant can face. It's a minimum of six years in the Illinois Department of Corrections all the way up to 30 and then sometimes even more than that.

MICHAEL NORRIS: Probation is not an option in a class X felony. That being said, there's always an exception. It's like this law is eternal, except if you have a good lawyer. You can get class X felonies reduced to a felony that would allow you to get probation.
