- DUI

The Orr Law Firm, LLC focuses on DUI defense. Alcohol-related driving offenses and other serious criminal traffic infractions is all we handle. Rhidian Orr has chosen to make DUI defense the focus of his firm and has dedicated the last seven years of his practice to defending DUI cases. The Orr Law Firm has handled over 1,000 DUI cases and the attorneys at The Orr Law Firm have extensive training in DUI defense tactics and evidentiary processes. All the attorneys at the Firm are members of the National College for DUI Defense and are also certified in Standard Field Sobriety Tests at the same as level as police officers. Mr. Orr is also certified in the operation of the Intoxilyzer 5000EN, the breath machine used for all Colorado breath tests.

- DWAI

DUI and DWAI defense go hand-in-hand. Both are strict liability crimes with no mens rea attached. This means you do not have to intend to commit the act or even know you were committing the act; you just actually have to commit the act of driving under the influence or while ability impaired. DWAI is the acronym for "driving while ability impaired". Driving while ability impaired means driving a vehicle when a person has consumed alcohol or one or more drugs, or a combination of both alcohol and one or more drugs, which alcohol alone, or one or more drugs alone, or alcohol combined with one or more drugs, affects the person to the slightest degree so that the person is less able than the person ordinarily would have been, either mentally or physically, or both mentally and physically, to exercise clear judgment, sufficient physical control, or due care in the safe operation of a vehicle.

- DUID

As law enforcement efforts to crack down on drunk drivers increase, we are seeing an alarming trend of clients being charged with driving under the influence of drugs. "Driving under the influence" means driving a vehicle when a person has consumed alcohol or one or more drugs, or a combination of alcohol and one or more drugs, which alcohol alone, or one or more drugs alone, or alcohol combined with one or more drugs affects the person to a degree that the person is substantially incapable, either mentally or physically, or both mentally and physically, to exercise clear judgment, sufficient physical control, or due care in the safe operation of a vehicle.

- UDD

Underage drinking and driving (UDD) is a common and serious offense in Colorado. The legal limit for a minor is .020. BAC levels from .02 to .05 for all persons under 21 years of age will be charged with underage drinking and driving. Minors with BACs greater than .05 will be charged the same as adults.

- Vehicular Assault

Vehicular Assault cases in Colorado are serious crimes with serious punishments. Vehicular assault is a felony in Colorado and dependent upon the extent of the injuries suffered by the victim, you could be facing 1-12 years in prison and/or a significant jail sentence along with substantial fines and restitution costs. Vehicular assault involves serious bodily injury and anytime someone is seriously injured in an accident and it is determined that you were negligent (often times due to alcohol or drug impairment). Even a first offense has prison attached as a possible penalty. If you were under the influence of drugs or alcohol at the time of the accident, the District Attorney will likely seek the maximum sentence possible.

- Vehicular Homicide

Vehicular homicide and vehicular assault are serious felony crimes, but are distinguishable by the degree of injury. While both crimes are serious, vehicular homicide is the more serious of the two and carries the more severe penalties. Both vehicular assault and vehicular homicide involve reckless driving and driving under the influence or while impaired by alcohol and/or drugs.

- Vehicular Eluding

Any person who, while operating a motor vehicle, knowingly eludes or attempts to elude a peace officer also operating a motor vehicle, and who knows or reasonably should know that he or she is being pursued by said peace officer, and who operates his or her vehicle in a reckless manner, commits vehicular eluding.

- Careless Driving Causing SBI/Death

Careless driving causing SBI/death is a serious charge with serious consequences in Colorado. The Orr Law Firm LLC has experience handling these cases and will passionately fight for your rights. Careless driving is a fairly common traffic offense in Colorado. When the police officer doesn’t know with what to charge you, they throw in careless driving as the catch-all. However, when someone is injured or dies and you are determined to be the at-fault driver, you will be charged with a class 1 misdemeanor traffic offense known as careless driving causing serious bodily injury/death. The possible penalties for this offense are ten days to one year imprisonment in the county jail and a fine of $300 to $1,000, or both.

- Traffic Offenses

- DMV Hearings

DMV hearings, also called administrative hearings, take place at the Colorado Department of Revenue, Division of Motor Vehicles office. There are three (3) main types of hearings: Express Consent Hearings (EC), Point Suspension Hearings (PSH), and Probationary Driver’s License (PDL) Hearings.

- Driving While Suspended Under the Financial Responsibility Act

Any person whose license or other privilege to operate a motor vehicle has been suspended, cancelled, or revoked, and restoration thereof or issuance of a new license is contingent upon the furnishing of proof of financial responsibility for the future, and who, during such suspension or revocation or in the absence of proper authorization from the director, drives any motor vehicle upon any highway in Colorado except as permitted under this article, is guilty of a misdemeanor and, upon conviction thereof, shall be punished by imprisonment in the county jail for not less than five days nor more than six months and, in the discretion of the court, a fine of not less than fifty dollars nor more than five hundred dollars may be imposed.

- Driving Under Restraint

Driving Under Restraint is one of the easiest cases for the prosecution to prove. Driving Under Restraint is broken out into two separate charges; alcohol/drug related and not alcohol/drug related.
