Areas of Law Description
Our practice areas include:
- Workers' Compensation
Workers' compensation covers all types of worker injuries, including back injuries, knee injuries, shoulder and arm injuries, carpal tunnel syndrome, burns, and other types of worker injuries. Workers' compensation covers all types of injured workers, including the following: Office workers and managers; Tradesmen, construction workers, and heavy equipment operators; Factory workers; Airline employees; Truck, package, delivery drivers, and dock workers; Public transportation and government employees; Nurses and health care workers; Railroad worker injuries covered under the Federal Employer's Liability Act (FELA).
- Motor Vehicle Accidents
Insurance companies are "for profit" businesses, who answer to investors more than they do to policy holders. When you are speaking to an insurance adjuster or an investigator from the insurance company, his or her goal is to minimize the amount the insurance company will have to pay on your motor vehicle accident claim, possibly even denying your claim. At the Orzoff Law Offices we act immediately to protect our client's interests. Our personal injury attorneys review all communications, documents and settlement offers to ensure you don't sign or say anything that could jeopardize your right to full and fair compensation for your losses.
* Car Accidents
If you were hurt in a car accident in the Chicagoland area, you can bring a claim against the other driver's insurance policy if the other driver was wholly or partly at fault for causing the accident. In order to bring a successful claim, you need to prove that: 1) the other driver was at least partly at fault, and 2) you were hurt as a result. In addition, if you want to receive a fair settlement on your claim, you need to understand the full cost of your injuries and other losses. If you don't know this, you will not know if the settlement is a low-ball offer or if it is fair and reasonable.
* Uninsured/Underinsured Motorist
Uninsured motorist coverage operates in a similar manner to underinsured coverage, except that your insurer will pay all of your expenses and damages because the person who caused the accident did not have liability insurance. Uninsured motorist coverage should also cover the cost of your damages if you were hurt in a hit and run accident. In Illinois, it is mandatory to carry uninsured/underinsured motorist coverage. The personal injury lawyers at the Orzoff Law Offices will review both the other driver's insurance policy and your own insurance policy to see which policy can pay for your damages and losses
* Truck Accidents
At the Orzoff Law Offices, our attorneys work with accident investigators and industry specialists to expose negligence that leads to truck accidents. We subpoena a driver's log book, review his or her licensing and training record, and interview eyewitnesses. We identify violations of the law and general carelessness on the part of drivers when holding them legally liable for our client's injuries. Our firm represents clients injured in truck accidents due to the following: Excessive speeding; Driver fatigue / falling asleep at the wheel; Wide angled turns; Lane drift; Lack of a rear guard, resulting in under riding; Lack of proper safety reflectors; Tire blowout; Load shift.
* Motorcycle Accidents
It is usually the result of negligence on the part of a car or truck driver who wasn't paying attention to the traffic around them and violated the right of way of a motorcycle, including situations where: Oncoming cars making an abrupt left hand turn in front of a motorcycle; A car or truck swerving into the motorcyclist's lane because they didn't check their blind spot; Not giving enough stopping room and rear-ending the motorcyclist at a stop light. These are all examples of common motorcycle accidents on Illinois roadways. In each of these cases, the car or truck driver can be held financially responsible for the injuries he or she caused.
* Pedestrian & Bicycle Accidents
It's unfortunate, but police and drivers often assume that the bicyclist was at fault in bicycle-car accidents. The police may or may not have done a very thorough investigation and usually the walker or biker is so injured they do not have a clear memory of the accident. That is when the investigative skills of an experienced lawyer become critical. If you are unsure who was at fault, talk to an attorney so we can try to reconstruct the accident to see if there is responsibility on the part of the driver. We have experience reconstructing these types of accidents. We will not let our clients get less than they deserve.
* Public Transportation Accidents
Public transportation entities have a number of safety regulations and procedures they are expected to follow. When accidents happen, investigators are more likely to underscore the things a CTA or Metra employee did that were right as opposed to mistakes or failures on their part. Additionally, investigations are conducted by the CTA and Metra themselves. Consequently, it stands to reason they are more likely to identify evidence that absolves them of any responsibility instead of highlighting negligence and errors they could be held liable for. Hiring an attorney who can meticulously review the final report of an investigation into an accident, identify conflicting information, and locate eyewitnesses who do not corroborate the "official" story, is important in building your case.
- Personal Injury
We represent individuals who have been seriously injured due to the negligence, carelessness or recklessness of another person. Some of the types of accident cases we have handled include: Car accidents; Truck accidents; Motorcycle accidents; Injuries on public transportation (buses and subways); Motor vehicle accidents caused by drunk drivers (dram shop liability); Railroad accidents (under FELA, the Federal Employers Liability Act); Construction accidents; Dangerous property conditions (premises liability), including slip and fall accidents and dog bites and animal attacks; Defective products (product liability); Medical malpractice.
* Back Injuries
Many different types of work activities can lead to temporary or permanent back injuries. From lifting to twisting injuries, to herniated and bulging disks, to auto accidents, your on-the-job activities can be very hard on your back. Even OSHA requirements and good ergonomics in your work environment can't prevent all back injuries, which are expensive, painful, and possibly job-ending. If you have injured your back on the job, Illinois workers' compensation is supposed to be there for you. You are entitled to compensation for doctor and hospital bills, rehabilitation, inability to work, permanent work restrictions and disability, and lost wages.
* Burn Injuries
If you were injured in a motor vehicle crash or a workplace accident, you may have been surprised when the doctors told you that you had a burn injury even though there was no fire. A burn is a skin injury that can come from a number of causes: electrical burns, chemical burns from car airbags and friction burns (called road rash) in motorcycle accidents. Even a seat belt can cause an abrasion "burn." The personal injury lawyers at the Orzoff Law Offices have helped many people who suffered burn injuries in car and truck accidents, in motorcycle accidents and in workplace accidents.
* Brain & Spinal Cord Injuries
Brain injuries and spinal cord injuries often have long-term effects on an injured person's ability to accomplish daily tasks, to hold a job and to maintain his or her earning power, as well as on overall health. At the Orzoff Law Offices, our goal is to ensure injured people and their families receive the financial compensation needed after a serious injury, not only to cover medical bills today, but to compensate for lost wages and medical needs in the future. If a child or adult is completely disabled and will need skilled nursing care for the remainder of his or her lifetime, our lawyers can explain how to establish a special needs trust to provide for his or her healthcare needs in the future.
* Wrongful Death
When families come to us, they want more than anything to understand how the tragic incident that caused the death of their loved one could have happened. In the case of medical malpractice, in particular, the family may be unsure if there was any fault. Once our firm has been retained, we act immediately to assemble a team of experts to investigate: In motor vehicle accident cases, we investigate the accident scene, interview witnesses and when necessary, work with reconstruction experts; In workplace accident cases, we look for violations in duty of care toward employees, such as OSHA violations or a paper trail documenting known hazards; In medical malpractice cases, we work with medical experts who understand that particular field of medicine to identify negligence and deviations from standards of care.
