Additional Areas of Law: Medical Negligence
Areas of Law Description
The lawyers in our specialist medical negligence department are very experienced in a wide range of cases against hospitals, GPs, surgeons, midwives, nurses, pharmacists, physiotherapists, care homes and other medical practitioners.
- General Practitioners
There is no question that general practice is the bedrock of the NHS and many GPs enjoy the respect and trust of their patients. We realize that this can make it difficult for people to claim negligence against a doctor who, in many cases, has treated them and their family members for generations. However, given their increasing work load, GPs sometimes make mistakes that can lead to the serious physical and psychological detriment of the patient. In reality, you’re not suing the doctor personally, you’re suing the NHS. Thinking of it this way can often help you feel more confident.
- Cerebral Palsy Compensation
Our solicitors are highly regarded medical negligence specialist and have many years experience in handling with cerebral palsy litigation and bringing cases to successful conclusions. It is very gratifying to help deliver justice in these important cases and the compensation awarded can deliver the financial security needed to maximize the long-term quality of life for the child and his or her carers.
- Children’s Medicine
Fortunately, in England, paediatrics is not a high-risk area, in terms of the number of negligence claims. However, some of the largest financial payouts have been for multiply disabled children, whose injuries were perinatal and whose life expectancy is long.
Children who are injured by negligent medical treatment are entitled to compensation. The law in this area is no different except that claims for children are brought by an adult for the benefit of the child and Legal Aid is more widely available.
- Cosmetic Surgery
An estimated 75,000 cosmetic and plastic surgery operations are performed in Britain privately and on the NHS each year. The number of negligence claims is on the increase despite the introduction of regulations by the National Institute for Health and Clinical Excellence (NICE) Many claims are brought due to the failure on the part of the medical expert to adequately explain the risks of the procedure, the actual procedure itself or due to the postoperative care. We are able to deal with all aspects of cosmetic surgery claims including: breast and facial surgery, chemical peels, liposuction and laser eye surgery. We can help with claiming for cosmetic surgery gone wrong.
- Accident & Emergency
We all know how busy accident and emergency departments can get. Couple this with the absence of senior doctors and radiographers to deal with the wide range of acute problems, and unfortunately the chance of mistakes being made increases. Negligence types include: missed or late diagnosis, failure to refer, inadequate treatment, missed fractures, missed foreign bodies in wounds or inadequate cleaning and inappropriate discharge.
- Eye Cases
The same laws apply to Ophthalmologists as to other medical practitioners. Typical negligence cases involve:
• Laser eye treatment (including Lasik) for the correction of long- or short-sightedness
• Cataract surgery
• Failure to detect and treat foreign bodies
• Delay in the diagnosis and treatment of glaucoma
• Delay in the diagnosis and treatment of retinal tears and retinal detachments
Involving the administration of general or local anaesthetic drugs, doctors who specialize in this area are called anaesthetists. Typically injuries are caused either by over dosage leading to brain damage or death or under dosage leading to awareness during surgery causing serious physical and mental damage.
- Care of the Elderly
Detractors of medical negligence litigation routinely belittle its importance. However, we at PH Solicitors believe that our experience of helping older people alone, gives us reason for pursuing the rights of our clients.
Older clients often face significant barriers to gaining the justice and dignity they deserve from the NHS, private care homes and other medical practitioners – we think is simply not fair.
In our efforts to redress this imbalance PH’s medical negligence team will resolutely assert the rights of older clients who have not received the standards of care which they are entitled to expect.
- Surgical Errors
Despite the immense skill of surgeons and continuous improvements in surgical techniques that seek to minimize risks and improve success rates, mistakes during operations do sometimes happen and can have serious and long term implications for a patient. The facts and complexity of each Surgical Negligence case can vary greatly which is why the in-depth knowledge and experience of our solicitors in getting to the facts and uncovering the technical side can prove invaluable. They are able to provide the best possible representation and have helped many people to make successful Surgical Negligence compensation claims.
Every year in the UK thousands of people suffer from a range of clinical mistakes involving bones, joints and tendons – from missed diagnosis of fractures or poor outcomes following joint replacements to simple cuts that lead to impaired movement and disability. Failure to take care in these circumstances can leave our clients facing pain and suffering for many months, loss of earnings and an affected quality of life. Compensation can be sought for the full effects of any negligence.
Mistakes made in gynaecology and obstetrics account for over half of all medical negligence claims. So our solicitors have a great deal of experience in this area. The commonest gynaecological claims are for misdiagnosis but there are many other types of claim due to complications resulting from surgery.
- Pregnancy & Birth
Over the years the medical negligence experts at PH Solicitors have successfully recovered damages for many mothers and new born babies and have developed an expertise in this varied area of medical practice.
Obstetric claims can cover: mismanagement of labour by a midwife, failure to recognize a high risk patient, inadequate pain relief, perineal trauma, delayed delivery, maternal or foetal bleeding, misinterpretation of scans and birth injury including cerebral palsy.
- Gentamicin Overdose
PH Solicitors are experienced in handling cases involving the administration of Gentamicin and have helped people receive significant compensation for their pain and suffering. If you have suffered Gentamicin-related problems as a result of medical negligence, you may be eligible to make a compensation claim – we can quickly help you to decide whether or not it is feasible to make a claim and can advise on No Win No Fee, Legal Aid and other potential methods of funding.
