Car Accident Injury Lawyers

CHARLES H. RITTGERS: The bulk of our personal injury practice is car accidents. The people that we normally represent are the people that are seriously injured in the car. That could be a passenger, could be multiple passengers, could be the driver of the car itself.

There are different avenues in attempting to collect monies for these people and the lost wages for their pain and suffering, for their medical bills. And those sources include not only the wrongdoer's insurance company but also our clients' own insurance, uninsured, underinsured motorist coverage.

There are certain injuries that the insurance industry tells us, well, they're not really injuries. They put a bad connotation on whiplash as if that's not an injury. A whiplash injury can be as serious as a broken leg or a broken back. And the reason for that is whiplash injury causes scarring to muscles and tendons. And when the muscles and tendons rub on that scar tissue, it causes severe pain.

And if you are a blue-collar worker who works hard labor by lifting and doing what's required in your job on a daily basis, you might not any longer be able to hold that job because of the pain. There is no charge for that initial consultation.

Divorce and Collaborative Law

ELLEN B. RITTGERS: The common misconception is I can't do collaborative because there's too much here. We have multiple businesses and high income. And that actually is the perfect case.
JASON A. SHOWEN: Collaborative law is a great way of approaching domestic relations cases.
ELLEN B. RITTGERS: I think the biggest thing is the fact that the two parties work together. And so then if they have any children, they're not going back and forth to court.
They are not turning their lives over, their finances, or their children to somebody in a robe who's going to listen to the facts and make orders.
JASON A. SHOWEN: They are on the front lines making the decisions for themselves.
ELLEN B. RITTGERS: You sign a contract, which lays out all of the rules. In difficult cases, you might bring in a third collaborative lawyer to help work with all four parties around the table.
JASON A SHOWEN: If we're representing somebody, we're going to tell them what the realities of their case is.
ELLEN B. RITTGERS: If they work together and they're not fighting each other, they're going to pay less in attorney fees.
JASON A. SHOWEN: 90% of all domestic relation cases, they come and hire us. They end up settling. Any way that we can start approaching now to address getting these people beyond whatever issues are causing them to break up and focus on the future and future communication is a great step in the right direction.

Family Law Attorneys

ELLEN B. RITTGERS: In domestic relations practice or family law practice, I focus on divorce and custody. Divorce, of course, will involve division of all assets, allocation of debt, the matters of spousal support. I think of custody as almost a different area of the law. We're focusing on the children or on the child.
JASON A. SHOWEN: Bad things happen to good people at lot. It's a very emotionally charged business. It's a very emotionally charged situation. It's next to death. Many think divorce is the most devastating thing that could happen to somebody.
There's so many areas inside of a domestic relations case that have the potential of going awry that you may need the court's assistance, which may mean that you have to physically try the case.
RENEE L. CRIST: One party might accuse the other of either abusing them, harassing them, stalking them. So then the other party has the option to go in the domestic relations court and ask for a civil protection order. And what that does is that then prevents the other party from continuing to abuse, harass, and stalk them. And then they have to move out of the residence at that time.
JASON A. SHOWEN: It's something that's prevalent in society today, whether we like it or not. You spend a lot of time in the courtroom. And you're constantly preparing for court. You're constantly preparing how to try the case, your witnesses. Divorce is as traumatic as a death in the family may be.
ELLEN B. RITTGERS: It's a more emotional area of law than many other areas of law.

Motorcycle Accident Lawyers

CHARLES H. RITTGERS: Motorcycle accidents are different as far as the extent of the injuries. A motorcycle operator is not protected like a car driver with sheet metal all around them. Car drivers usually don't pay any attention to motorcyclists. They don't see them. When they do see them, they don't see them as a threat.

They're more likely to take the chance in pulling out in front of a motorcyclist.

Motorists will often blame the motorcycle rider for the accident by claiming that they were going too fast, they weren't wearing a helmet, when in fact it's the car driver who isn't obeying the rules of the road.

Because we're playing with the radio, talking on our cell phones, we lose our concentration. And for whatever reason, we may go over the double yellow line. We may go off the edge of the road. And we may ignore that red light because we're too busy talking or having an argument over the cell phone. Or we're turning around, making sure that our child is seatbelted in.

Oftentimes, that failure results in some serious injuries to some third party that was minding their own business. We all are required as drivers to follow the rules of the road.

Ohio OVI, Drunk Driving Defense

CHARLES H. RITTGERS: OVI, which is operating a vehicle under the influence, is what most people would recognize as a DWI, DUI. Part of the new OVI statute is that they've clarified and classified certain drugs and the limited amount of drug you can have within your system should they decide that you're impaired of using a drug, like cocaine, marijuana, amphetamines, et cetera.
NICHOLAS D. GRAMAN: The main concern people have who have been charged with a drunk driving offense usually is what kind of impact it's going to have on their license and their ability to get around. And then they're also concerned about the loss of their freedom.
CHARLES H. RITTGERS: Your rates will go up once your insurance company finds out that you've been convicted of OVI. You're usually placed on probation. Or if you're a car dealer and you're convicted of OVI in Ohio, you're going to lose your dealership. You could lose your job if you work for an insurance company.
NICHOLAS D. GRAMAN: They're concerned they're not going to be able to drive, to take care of their kids, to go to work, to be able to earn a living.
CHARLES H. RITTGERS: I'm certified in field sobriety testing. I've taken the same course that the law enforcement officers take. And when I'm in the courtroom and I hear their testimony as how they gave the field sobriety test to my client, I want to make sure that they've done them correctly. And I can safely say that in over 90% of the cases that I have had that the officer never has done those tests correctly.
It's not necessarily against the law to drink and drive. It's against the law to drive impaired. I have three or four Ohio Supreme Court cases that have changed the law in Ohio when it comes to OVI. We believe we're usually at the cutting edge of the OVI defense.

Truck Accidents

CHARLES H. RITTGERS: A trucker is a professional driver. They should be held to a higher standard, specifically because they have a special license, which is called CDL. And they are driving an instrument of death if it is not properly maintained and taken care of and driven according to the rules of the road.

When a person is injured or killed in a collision with a semi, they need to look at the personnel file of the truck driver, whether he has criminal convictions, what is his training, whether he's ever been cited before. They need to look at the inspection records of the semi. They need to look at cell phone records. Was the truck driver texting, going 65 miles an hour.

The load that they're carrying shifted, possibly because it was not properly loaded to begin with. There are so many things that a lawyer needs to look at.

JASON A. SHOWEN: The insurance companies are going to fight you tooth and nail about the smallest or the biggest of injuries. No matter how obvious or how easily proven, they are going to run you through. And therefore, you have to have a firm that's going to be able to understand that, defend it.
