Areas of Law Description
Seeger Weiss's practice areas include:
- Personal Injury
Over the last ten years, our personal injury attorneys’ have recovered more than $6 billion dollars for victims of personal injury. Unlike most personal injury law firms, we have the resources and experience to go “toe to toe” with the big defense firms and the insurance companies, but offer the personalized, client-friendly service of a small firm.
- Drug Injury
Drug manufacturers have a duty to make sure that medications they sell are not unreasonably dangerous and contain sufficient warnings about potential drug injuries and side effects. With the help of physicians, patients can evaluate the risks and benefits before taking a medication. However, some pharmaceutical companies fail to take the simple steps to protect consumers and place profits before the public's safety.
- Toxic Exposure
Toxic injury is another unique type of personal injury lawsuit, when victims suffer injury, disease, or wrongful death after being exposed to a chemical. Toxic exposure can occur through consumer products, chemicals used on the job or at home, or through contaminated drinking water or air. Victims most susceptible to toxic injuries are those who have experienced prolonged exposure to a dangerous chemical, often on a daily basis.
- Food Poisoning
Food poisoning, also referred to as food-borne illness, is caused by agents that enter the body through the ingestion of food. Infectious organisms including various bacteria, viruses and parasites are the most common cause of food poisoning. Harmful toxins and chemicals (noninfectious agents) also can cause illnesses.
- Lead Poisoning
Lead is classified as a "heavy metal," and is highly toxic to our bodies. Lead can enter your body by inhaling it in the form of dust particles in the air, or by putting something in your mouth that has been contaminated with lead, such as water with high lead levels in it. Lead is highly dangerous to people as it may accumulate in bone marrow and nerve tissue. For many years lead was used in a wide variety of products including gasoline, solder, plumbing pipes, and most notoriously, household products including house paint. In an effort to reduce people's exposure to lead and probability of lead poisoning, in 1978, the sale of lead based paint for homes was banned, and the amount of lead permitted in gasoline was reduced.
- Asbestos
Asbestos and mesothelioma litigation is the longest-running category of drug and toxic injury lawsuits. Since 1940, more than 28 million workers have been exposed to asbestos fibers, a dangerous insulation material, that causes the deadly lung cancer, mesothelioma.
- Class Actions
Banding together hundreds—or even hundreds of thousands—of individuals into one lawsuit gives the case more merit and forces the defendant to take notice. For many victims, class action litigation has provided the only meaningful way for redress from widespread discrimination, fraud, and other violations of the law. Just look at the benefits of class action litigation against major tobacco companies in the past, and Wal-Mart and Toyota more recently.
- Securities
Securities litigation arises out of incidences of investment fraud, also known as stock fraud or securities fraud. Plaintiffs in securities litigation seek damages when they have been misled by false information, which encouraged them to make purchases or sales decisions that often result in losses.
- Commercial Litigation
Our proven accomplishment and integrity in commercial litigation allows us to actively support and advance our clients' goals. We represent both public and private companies, as well as individuals giving them the confidence and commercial litigation counsel most needed to make well-informed decisions throughout the process.
- Commercial Law
Commercial law (or business law) governs business and commercial transactions. It involves litigation between parties in response to a loss of economic value during an exchange of goods or services. Transactions can be between private individuals, public entities or consumers.
- Defective Product
It’s clear that federal regulatory efforts struggle to provide the level of protection and safety that is needed in a global marketplace. As U.S. District Court begins to hear more than 100 federal lawsuits filed against Toyota and new federal legislation is considered that would hold foreign manufacturers accountable for selling defective and dangerous products like Chinese drywall, you may wonder whose looking out for the little guy. We’re pleased to say that Seeger Weiss is.
- Defective Drug
Just because a drug is “on the market” does not mean that its safety is guaranteed. Defective drug attorneys regularly represent individuals who have been injured and experienced moderate to severe trauma due to a defective drug. Attorneys at Seeger Weiss encourage individuals who are having more than the “typical” side effects from any drug they’re taking to contact an attorney who might be able to help them.
- Dangerous Side Effects Recall
Drugs with dangerous side effects are still a growing problem. Not a week goes by without a new warning or recall being issued by a company or the Food and Drug Administration (FDA) regarding dangerous side effects of a pharmaceutical drug. Although some drugs work well for many patients, others are particularly dangerous because of their debilitating side effects that can cause extreme injury and discomfort.
- Tort
Tort actions were created as a non-legislative way to compensate wrongs and harm done by one person to another's person, property or other protected interests, e.g. physical injury or reputation. The tort system, first, tries to compensate victims for their losses. Secondly, it tries to set an example of liability to avoid future harm or accidents.
- Auto Accidents
Autos are ubiquitous today. Everywhere we travel (whether by foot, car or bike) we encounter other automobiles. Some drivers are speeding; some are distracted by a cell phone or by eating their lunch; others are in their “own world” and show a disregard for anyone else on the road.
- Catastrophic Injury
Victims of catastrophic injuries will likely require medical care for the rest of their lives. Many will not hold a cup, pick up a pen, grab a pill out of a bottle, or dress themselves again. Chinese gymnast, Sang Lan, was paralyzed during a 1998 competition doing a routine warm-up vault. She landed on her head and sustained a spinal cord injury that left her paralyzed from the chest down. To type on a computer keyboard, she must use small sticks attached to her hands.
- Medical Malpractice
The medical malpractice system has two primary goals: to compensate injured patients and to deter physicians from careless behavior. Patients who are injured by substandard healthcare are entitled to compensation. Medical malpractice exist when a healthcare provider undertakes care of a patient and their duty to the patient was breached by failing to maintain a relevant standard of healthcare resulting in injury.
- Misdiagnosis
A medical misdiagnosis is not only finding the wrong illness, but it can also be the result of a doctor misjudging the severity of an illness leading to over and under treatment. Medical misdiagnosis is a serious problem in our health care system. Studies have found that about 20 percent of fatal illnesses are misdiagnosed. Despite significant medical progress since the 1930s, the medical community is distracted from the alarming rate of medical misdiagnosis. The rate of medical misdiagnosis has remained unchanged despite the significant achievements obtained since that time period.
- Birth Injuries
The birth of a child is a special event as family members joyously welcome a new son or daughter into this world. The mother is relieved as she is able to move the child that has been in her womb into this world to begin a wonderful life. Of course, during the mother’s pregnancy doctors work to ensure the baby’s development is safe and healthy. Likewise, parents hope their children are born healthy as they want their children to grow up fully capable of finding enjoyment in the world.
- Nursing Home Abuse
The decision of whether to place a family member in a nursing home or long term care facility is a difficult one as all parties involved want to ensure that their loved one receives the best care available and is able to live comfortably. Elderly residents of these facilities and their families depend on the nursing home staff to provide care and ensure their safety. Many of the elderly care facilities in the United States provide excellent care for their inhabitants, however, there has been an unfortunate increase in the number of nursing home residents who have been the victims of abuse or neglect by the nursing home staff. The reason why the residents of these homes have been the victims of abuse is not entirely clear.
- Surgical Errors
The impact of surgical errors is significant. Any time an error is made, the potential impact on the patient receiving medical treatment can be life altering or grave. The frequency of surgical errors is low as compared to the number of surgeries performed, but because the effects can be severe, any error is unacceptable. As a result, the NQF’s categorization of surgical errors as “never events” is reasonable.
- Workplace Injuries
"Every day in this country, more than 14 workers lose their lives in preventable workplace tragedies—close to 100 deaths every week,” David Michaels, OSHA Assistant Secretary recently quoted. He went on to say, “even further from the headlines and public consciousness is the fact that 4.6 million workers suffer from serious occupational injuries each year.” The sad truth is that the majority of these workplace injuries were preventable.
- Construction Site Accidents
Every year, on-the-job construction site accidents cost US building owners, general contractors, and design engineers billions of dollars—and cause worker pain, long recuperation time, and sometimes chronic disability and death. We know the stories well: the once-productive worker forced to retire early by a nagging back injury; the worker whose life will never be the same when an on-the-job accident leaves him blind in one eye; the worker whose hip is crushed under the waist-high weight of a trench collapse as he tries to rescue a coworker.
- Car Accidents
Motorists are more likely to be injured in urban car accidents involving red-light running than in other types of urban crashes. A 2009 Insurance Institute Study for Highway Safety found it was the cause of 22 percent of car accidents. And injuries occurred in 39 percent of crashes involving running a traffic control; this was the highest proportion of any crash type.
- Truck Accidents
Vehicle accidents have led to great loss in both lives and monetary or property damage. Although cars make up the majority of vehicles involved in accidents, large trucks still make up a significant portion of vehicles involved in accidents. According to the National Highway Traffic Safety Administration, in the year 2004, one out of every 8 traffic fatalities resulted from an accident involving a large truck.
- Motorcycle Accidents
Each year many thousands of people are injured or killed in motor vehicle accidents. Accidents also account for the loss of billions of dollars in property damage and medical fees annually. Most accidents involve passenger cars, however, trucks and motorcycles also account for much of the toll in injuries, deaths, and monetary losses. Recently, the National Highway Traffic Safety Administration released data concerning traffic accidents on a nationwide basis for the year 2004. The information is overwhelming as there were an estimated 6,181,000 traffic accidents reported to the police in 2004. These 6 million plus accidents resulted in 42,636 deaths and 2,788,000 injuries.
- SUV Rollover Accidents
The increasing popularity of sports utility vehicles or "SUVs" on the roads today has had a significant impact on road safety. In the early 1990s, fewer than 1 million SUVs were sold each year, and they did not constitute a significant number of vehicles on the road. The number of SUVs sold each year since then has grown drastically. In 2003, car manufacturers were making significant profits from their SUV models as approximately 4.5 million SUVs were sold to the consumer on the retail market. Today, sports utility vehicles make up approximately 10% of all vehicles on the road, numbering about 22 million SUVs.
- Child Injuries and Wrongful Death
Even with the precautions of child safety gates, car seats and plugs for electric outlets, children can still get hurt or die when defective products get through the safety nets. Toys and jewelry with lead paint. Magnets that can be swallowed then tear a little one’s intestines. Harmful teething numbing creams promoted for toddlers. Vaporizers that cause face and limb scarring forever. All of these products and more should never be allowed on the market but they slip through and contribute to unfortunate child injuries. Luckily, child injury attorneys such as Seeger Weiss are diligently working to make injustices known and receive just compensation for families.
