- Truck Driver Error

Federal Motor Carrier Safety Administration (FMCSA) regulations are in place to govern the hiring, training, and operation of commercial trucks. The regulations are designed to increase the safety for everyone sharing the road with big trucks. Unfortunately, the FMCSA cannot strictly enforce the regulations, and truck drivers routinely avoid weigh stations and check points. The result is that many collisions are caused by truck drivers who are too tired, improperly trained, or in too much of a hurry to reach their destination.

- Mechanical Failure
Large semi tractor-trailers are complex machines comprising many systems that are all required to operate correctly at the same time to prevent breakdowns and equipment failure. Even the safest truck driver is at the mercy of company policies governing regular maintenance and supervising mechanics in charge of keeping the trucks running. If any one of the parts or systems fails inspection, doesn’t function properly, or breaks down at highway speeds, a catastrophic accident can result.

- Loose Freight Accidents

Dockworkers, truck drivers, and truck company managers have a responsibility to make sure that their freight is sufficiently secure to prevent loose freight from causing damage in the event of an accident. According to section 393.102 of the Federal Motor Carrier Safety Administration (FMCSA) regulations, cargo securement devices and systems must be capable of withstanding three forces, each applied separately. These forces include deceleration moving forward, acceleration moving backwards, and acceleration moving laterally or when struck from the side.

The Federal Motor Carrier Safety Administration (FMCSA) reports that more than 20,000 people are killed or injured each year on our nation’s highways because of truck operator fatigue. Although current regulations are clear that commercial drivers must rest at least eight hours for every ten consecutive hours behind the wheel, over-tired drivers often cause serious injuries and death. In an industry that moves more than nine billion tons of products every year, faster deliveries mean more profits.

- Substance Abuse, DUI

The National Highway Traffic Safety Administration takes truck driver drug and alcohol abuse seriously. Commercial truck drivers are held to very strict federal standards regarding the use of narcotics or consumption of alcohol on the road. Federal Motor Carrier Safety Regulations (FMCSR) specifically state that no driver may use or be under the influence of alcohol or narcotics within four hours of going on duty or operating a commercial truck. Any driver who violates the alcohol or narcotics rule must be removed from driving for a full twenty-four hours by the truck company. There is no “legal limit” for truck drivers.

- Negligent Hiring & Negligent Supervision

Undocumented workers who cannot read English road signs, drivers with suspended licenses, and convicted drunk drivers are often hired to deliver products too fast, and with little regard for regulations. This year, more than 5,000 people will be killed on U.S. roads in accidents involving commercial trucks, many of them operated by unqualified and unsupervised drivers.
