Areas of Law Description

- Medical Malpractice

James E. Colleran, Esquire began practicing medical malpractice law early in his career. He started his career at a well-known plaintiff's law firm in Philadelphia and quickly earned a record of success and an impeccable reputation throughout the legal community. In 1995, he founded The Colleran Firm. He and the other members of his firm, including all four of his children, have had continued success and have remained at the top of their field.

- Birth Injuries

A birth injury can leave an entire family in emotional pain and economic devastation. The injury or death of an innocent, helpless child can be too much to bear. During this difficult time, the support of a compassionate attorney can help you and your family make important decisions about the future.

- Cerebral Palsy

Cerebral Palsy is a type of brain damage that can occur because of an error during the birthing process. Cerebral Palsy is a hypoxic-anoxic encephalopathy injury to the brain that can cause severe developmental disabilities and symptoms such as impaired motor skill function, seizures, pain, speech disorders, vision loss, learning disability, cognitive disability and emotional difficulties.

- Injuries to the Mother

When a mother is seriously or fatally injured during birth, the infant and family will also suffer. This can be an extremely stressful time for the family as it tries to care for the newborn while suffering worry or grief over the injured mother. The family will have many questions and concerns, but may not know how to get help.

- Labor and Delivery Negligence

Labor and delivery can be a very beautiful time but it can also be a very dangerous time for infants and their mothers. There are numerous doctors, nurses, nurses' aides, and sometimes residents and medical students involved in the patient's care. It is possible that a staff shift change may occur during long births, creating potential for miscommunication and other errors. In many cases, babies are delivered by the obstetrician on call, not the woman's personal obstetrician. All of these factors can expose the mother and baby to risk.

- Surgical Error

If a surgical error resulted in significant harm or Wrongful Death, the patient and/or the patient's family may be entitled to compensation for medical bills, pain and suffering, lost wages, and other damages. Working with trusted medical experts, we build strong cases demonstrating the surgeon's negligence. We will also demonstrate the effect the injury will have on your life and the lives of your family members. If necessary, life-care planners and economists help us calculate your need for past and future damages.

- Anesthesia Error

Anesthesiologists play a critical role in surgical patient care. In the operating room, they are responsible for continual assessment of the patient's blood pressure, heart rate, breathing, temperature, level of sedation and other issues. While the majority of anesthesia care occurs without incident, even a minor error can be devastating.

- Infections/Complications of Surgery

Hospital infections are common and can be caused by surgery, the use of ventilators, the use of catheters, feeding tubes and IVs. Surgical procedures and complications may result in infection. Doctors may also fail to properly diagnose or treat a postoperative infection. While some infections are treated successfully, some cause serious issues such as wound pain, failure of the surgical procedure, need for additional surgery, organ failure or Wrongful Death.

- Delayed Diagnosis of Cancer

A delay in diagnosis of cancer can have disastrous consequences such as tumor growth and the spread of cancerous cells to surrounding tissues, lymph nodes or other parts of the body. Once a tumor grows or cancer metastasizes, the odds of successful treatment are reduced.

- Failure to Diagnose/ Misdiagnosis

In some cases, a failure to diagnose, misdiagnosis or a delay in diagnosis can significantly affect a patient's prognosis. When a patient's illness could and should have been diagnosed at an earlier stage, a failure or delay can result in a worsening of the prognosis or a death that was preventable.

- Failure to Diagnose and Treat Cardiac Disease

A failure to diagnose heart disease can lead to serious injury or Wrongful Death. Most types of heart disease are treatable with timely diagnosis and proper care. Most often, a failure to diagnose a disease or other medical condition involves a failure to order necessary diagnostic tests or a failure to properly interpret tests. In cases of cardiac malpractice, this may include chest X-rays, electrocardiographs and electrocardiograms (ECG and EKG), and exercise tolerance tests (stress tests). Ignoring a patient's risk factors and failing to properly assess a patient's clinical condition are also possible causes of misdiagnosis.

- Medication Errors

If there is an error with the prescription or administration of their medicine, patients can suffer serious injury or Wrongful Death. Unfortunately, medication errors are all too common. Whether the error is the fault of the physician, pharmacist or person administering the medicine, these mistakes can have devastating consequences.

- Radiology Errors

As patients, we often think that tests such as X-rays and MRIs will provide definitive answers about our medical issues. However, the reality is that the interpretation of these tests is subject to a range of variables, negligence and human error. The same test results may be interpreted very differently by different radiologists.

- Emergency Room Errors

Emergency rooms are becoming increasingly busy, forcing ER staff to handle nonemergency cases in addition to critically injured or ill patients. This creates even more interruptions in patient care and communication. The result is that decision-making ability, time spent with patients and continuity of care is often reduced. Physicians, nurses and other ER staff are still expected to practice a certain standard of care, however.

- OB/GYN Malpractice

Women's health, including obstetrics and gynecology, is a complex area of medicine. When OB/GYN medical malpractice occurs, many body functions may be affected such as reproduction, menstruation, bladder and bowel continence, and sexual function. In the worst cases, a surgical error, a birth injury or failure to diagnose cancer can result in serious injury or Wrongful Death.

- Brain Injuries

Without sufficient oxygen, permanent brain injury can occur. Patients who suffer oxygen deprivation are at risk for developing serious brain injuries. When these injuries are caused by medical malpractice, the patient and his or her family may be able to collect damages for their losses.

- Spinal Cord Injuries

Spinal cord injuries can be caused by the negligence of doctors, surgeons, anesthesiologists and other health care professionals. Unfortunately, even a minor spinal cord injury can result in severe and permanent disability. If you have suffered an injury to the spinal cord due to medical malpractice, speak with a Colleran Firm lawyer today.

- Amputation/Loss of Limb

Some medical errors can be corrected or the effects can be mitigated. When the error involves an amputation, however, there is no remedy. An amputation is a permanent condition that dramatically alters the patient's life. An amputation is one of the most debilitating injuries a person can suffer. In addition to the physical pain and disfigurement, many amputation victims suffer emotional trauma. There is also a long recovery period that typically includes physical rehabilitation and occupational therapy.

- Vehicle Accident

At The Colleran Firm, we represent many types of injury victims, including people who have been hurt in auto accidents. We use the skills we have developed while litigating medical malpractice cases to pursue compensation in vehicle accident cases. Our knowledge of complex medical issues is extremely valuable in all personal injury claims.

- Premises Liability

Property owners, both commercial and private, must exercise reasonable caution in keeping their property in a safe condition. The failure to do so may constitute negligence and entitle injured parties to monetary compensation for any related injuries or death. Premises liability matters can include relatively simple things such as dog bites and slip and falls or more complex matters such as work-related injuries or construction accidents.

- Personal Injury

No matter what causes a personal injury or Wrongful Death, you will need an experienced, aggressive lawyer to represent your interests. Most personal injury cases are ultimately a battle to get the negligent party's insurance company to adequately compensate the injury victim. Without an attorney to protect your rights, it is very unlikely that you will receive the compensation you deserve.

- Wrongful Death

An unexpected death forces family members to confront many issues simultaneously. With a compassionate, experienced personal injury lawyer on your side, however, you can begin to work through these issues. At The Colleran Firm, we have helped numerous families address the financial and legal concerns of Wrongful Death. We understand that you have suffered a great loss, and money cannot undo that damage. However, we also know that obtaining adequate compensation to pay your bills can ease some of your worries.
