Areas of Law Description
- Wrongful Termination
Locating, pursuing and landing a job can be a time-consuming, costly and often exhausting process. Once at your position, your commitment of talent, effort and time is valuable. If you are wrongfully terminated, you deserve the compensation and justice promised by employment laws and delivered by a skilled, experienced and hard-working employment law and wrongful termination law attorney.
Federal and state laws guarantee employees the right to work free of discrimination and harassment based on race, sex (gender), pregnancy, religion, national origin, age and disability and other protected classifications. Therefore, if you are denied employment, denied a promotion or are discharged on account of your protected status, you may have a claim.
- Age Discrimination
It is illegal for an employer to discriminate against any employee on the basis of age. The Federal Age Discrimination in Employment Act (ADEA) protects employees that are 40 years of age or older from all types of age-based discrimination. Equal opportunity laws protect workers from discrimination, provide them with compensation and punish employers. Additionally, these same laws protect employees from retaliation for complaining of age discrimination. Our firm has a comprehensive understanding of these laws.
- Sexual Harassment
Sexual harassment has no place in today's workplace. Where once sexual harassment was often tolerated, overlooked or misunderstood, it is now recognized as the cause of real and significant emotional and economic harm. Damages for sexual and employee harassment claims can be high, and employers often deny wrong doing and will even protect harassers. An experienced sexual harassment attorney can document the occurrences and emotional and economic harm, work to prove the guilt of the employer, and work to secure a fair compensation for the victim.
We are taught from a young age that if we do the right thing, we will be rewarded. Unfortunately, this isn't always the case in the workplace. Very often, an employee who suffers unlawful discrimination or harassment in the workplace is faced with a tough decision: report the illegal and discriminatory acts of his or her employer, or sit silently and endure the discrimination or harassment.
- Non-Compete and Trade Secret
Non-compete agreements are among the most varied documents in business law, and consequently are often reviewed by experienced and qualified employment law attorneys. Non-compete agreements can encompass an almost endless range of confusing and often harmful stipulations which limit the rights of employees to work at the company and geographical location of their choice.
- Employment Benefit Litigation / ERISA
The Employee Retirement Income Security Act (ERISA) was enacted in 1974 to regulate employee pension plans and other similar benefits. At The Galo Law Firm, we have a comprehensive understanding of ERISA laws and how they affect an employee's right to health and disability benefits under an employer's group plan.
- Wage and Hour Issues
Working for an employer each day requires commitment. Contributing your talents to your employer and promoting your employer's interests demonstrate your dedication. It is unfair, then, when your employer does not follow the law or the terms of your employment contract and does not pay you for the services you have provided. Issues regarding wage, hours, compensation, and overtime labor laws occur frequently in the workplace. They can involve withholding of earned pay or incorrect interpretations of your employment status and your rights under the Fair Labor Standards Act (FLSA) and other laws.
- Qui Tam
"Qui tam" is an unusual term with a clear and simple meaning. Qui tam is a federal legal provision which allows private individuals with knowledge of fraud committed against the U.S. federal government to bring suit against the fraudulent party on behalf of the government. In other words, if the company you work for is defrauding the federal government, you can take action. If you take action, you may gain financially. Qui tam, which is part of the federal False Claims Act, provides incentive to the "whistle blower" party of a claim. An individual who brings forward a successful qui tam suit receives between 15% and 30% of any award or settlement amount, plus any attorney fees.
- Severance Agreement
When employment has been terminated in a layoff or reduction in force, an employee may be asked to sign a severance agreement. This agreement usually involves compensating the employee, and almost always requires the employee to release and waive any and all legal claims that he or she may have against the employer. If you have been asked by an employer to sign a severance, separation or termination agreement, it is important to have an attorney review it to ensure that your interests are fully protected. We can negotiate with your employer to get the most for you.
- Employment Contract
You have probably heard that Texas is an employment "at will" state. This means that an employee can be fired for any reason as long as it is not an illegal reason. However, in some instances, an employer may elect to offer an applicant or employee an employment contract that modifies the at-will relationship. Whether you represent management or are an employee, we can assist you in negotiating and drafting your employment agreement.
- Business and Commercial Litigation
In San Antonio, with its millions of residents and thousands of businesses, there is an almost endless variety of businesses and business disputes. Business disputes can involve partnership contracts, business dissolution, buy/sell and purchase agreements and many other areas. All are different but have the same result - distraction, stress, and the possibility of the loss of assets and the right and ability to conduct business.
- Personal Injury
If you have been injured by another's negligence, you may be suffering pain, a loss of earning potential and overwhelming medical bills. As you recover, a lawsuit for damages can offer justice for others' carelessness, needed income at a difficult time, and compensation for expensive and medical care and treatment. We work with a network of medical professionals, accident investigators and expert witnesses to document your injuries and their effects, prove liability and negligence, and fight for your maximum financial award. We handle all types of personal injury cases, including workers' compensation and insurance bad faith claims.
