Areas of Law Description
The Kristy Law Firm serves clients in the following areas of practice:
- Insurance
In California, when an insurance company unreasonably denies payment of an insurance claim, the practice is known as insurance "bad faith".
• Auto Insurance
The Kristy Law Firm has handled a large number of auto insurance bad faith claims. Car insurance companies are notorious for unreasonably denying payouts on policies or lowball policy holders.
• Broker and Agent Negligence
If an insurance broker or agent fails to fully explain the terms of your policy or fails to fulfill your requests, they may be acting in bad faith. They owe a duty of care to the insured and are liable for any professional negligence.
• Disability Insurance
When a policy holder is collecting on a disability insurance policy, they are depending on their insurance to help them pay for bills and buy groceries. Disability insurance covers loss of income or loss of the ability to earn income as a result of accident or illness. Insurers should not deny claims of policy holders.
• Health Insurance
The cost of healthcare is steadily rising. Health insurance is absolutely essential to our peace of mind and we rely on it heavily. When an insurance company unreasonably denies a health claim, a person’s health, livelihood, and even life may be at stake. You may be denied care, you may have to sell possessions or file for medical bankruptcy. At The Kristy Law Firm, we fight for our clients against big insurers like Kaiser Permanente, Blue Cross, and Blue Shield.
• Homeowner’s Insurance
We routinely handle homeowners’ insurance claims and have done so since 2003. We understand, better than anyone else, the laws and regulations that govern the conduct of homeowners’ insurance companies. We fight to hold insurers responsible for homeowners’ insurance claims and for denying policy benefits to the insured.
• Liability Insurance
Liability insurance protects against the legal claims of others against the insured party. It is often called “third-party insurance” and is very important to have if you are involved in an accident that is your fault. Liability coverage is included in a wide range of insurance policies, yet companies still deny claims from policy holders.
• Life Insurance
A life insurance company denies a claim after the death of a loved one, thus making a difficult situation even more tenuous. Often, the family of the deceased is grieving, yet must cope with the frustration of the denied life-insurance claim. The Kristy Law Firm helps beneficiaries of life insurance policies hold their insurers up to their end of the bargain.
- Construction
We represent plaintiffs in cases involving faulty construction of homes. We also represent plaintiffs who are members of homeowners associations, and who have been harmed by their HOA. Buyers of new homes sometimes discover hidden problems in the construction. These defects may come to light years after the purchase.
• Soils Problems
Defects in the soil underneath a home can be a vexing, even terrifying problem. Cracking in interior walls, stucco, and the foundation often indicate that the underlying soil is defective. A builder who fails to properly compact or otherwise treat the soil before constructing the home may be liable for the damage that results – even years after the home was built
• Water Intrusion and Mold
At The Kristy Law Firm, we are experienced in fighting on behalf of people whose homes have suffered damage as the result of water intrusion and mold. Our relationships with experts, including industrial hygienists, architects, and contractors, help us to successfully litigate water-intrusion defect cases.
• Structural Defects
It may take years for a home’s structural defects to manifest themselves. Homeowners may eventually notice cracks in interior walls, exterior stucco, and concrete. Windows and doors fail to properly open and shut. Rainwater finds its way inside the home. A garage fails to drain properly.
• Building Products
Construction defects often result when the builder uses inferior building materials. These may be pipes, window frames, roofing material, and many other components of a home. Over time, the inferior building products manifest themselves in the form of plumbing problems, window or roof leaks, and many other problems.
• Landslides
Before a home is built – before the land is even graded – the developer must obtain the professional opinions of soils engineers about the suitability of the soil for construction above it. Underground landslides are relatively common. They may remain undetected for years, until water penetrating the soil activates them.
- Employment
We are employment trial attorneys who represent plaintiffs victimized by the unlawful conduct of their employers. We are experienced in handling cases involving wrongful termination, discrimination, harassment, overtime and break-period abuses, and failure to allow family and medical leaves.
• Wrongful Termination
We work hard at our jobs. We depend on our employers to treat us fairly. We are told that our employment is “at will” – that we can be fired at any time, for nearly any reason – or for no reason at all. But terminated employees have the law on their side when an employment termination violated a statute, regulation, or public policy.
• Harassment & Discrimination
California and federal law protect workers against discrimination and harassment in the workplace. Victims of discrimination and harassment may be eligible for special protection under the Federal Employment and Housing Act (FEHA) and California’s Department of Fair Employment and Housing, and by the California Labor Board.
• Family and Medical Leaves
California and federal law ensures the rights of workers to take leaves for the purpose of caring for ill or disabled family members; to recover from medical conditions; to safely complete a pregnancy and give birth; and to recover from a workplace injury.
• Wage-and-Hour Cases
Workers who are non-exempt under California law are entitled to overtime pay when they work more than eight hours in a day and 40 hours in a week. Furthermore, all workers are entitled to specified meal and break periods. Too often, California employers skirt these rules.
- Medical Malpractice
We are trial lawyers who represent the victims of medical negligence. When medical negligence results in death, we represent family members for the loss of their loved one. We take responsibility for understanding exactly what our clients have experienced.
• Arbitration
In California, health-care consumers who are victims of medical negligence are ordinarily entitled to a jury trial. In a jury trial, the attorneys for the consumer (the “plaintiff”) and the health-care provider (the “defendant”) present evidence to a jury in a California courtroom. At the end of the trial, the judge instructs the jury on the law that applies to the case.
• Medical Negligence
We are trial attorneys who represent plaintiffs — healthcare consumers who are the victims of a provider’s negligence (often termed “medical malpractice”). Institutions such as HMOs, independent hospitals, physicians’ organizations, and even pharmacy chains can be held liable for their medical negligence. Often, medical mistakes are the result of an institutional thirst for profits.
• Wrongful Deaths
The untimely loss of a beloved family member is a loss like no other. No earthly reward can make up for such a loss. Still, our civil justice system holds the wrongdoer responsible for causing the wrongful death. In cases of medical negligence that result in untimely death, we believe that litigating for the rights of our clients ultimately causes medical institutions to take more care and to minimize the risks of medical error.
