- DUI / DWI / Extreme DWI / Vehicular Crimes

DUI, DWI, & Extreme DUI charges are filed thousands of times in Arizona every year against people from all walks of life. These charges are serious, but defensible, with assistance from a DUI Lawyer in Arizona experienced in DUI, DWI, & Extreme DUI law. At the Law Offices of David Michael Cantor, P.C., the majority of our Attorneys are ex-Prosecutors, and all of our DUI Lawyers in Arizona know the system well.

* Vehicular Aggravated Assault
Vehicular Aggravated Assault typically is charged if somebody is drunk behind the wheel of a car and has an accident which results in serious physical injury or substantial disfigurement to another person, because a car qualifies as a “dangerous instrument.” In order to convict upon this charge, the prosecutor must show that the defendant’s driving was reckless and caused serious injury to somebody, that the defendant intended to seriously injure someone with his car, or the defendant wanted to scare someone with his car.

* Vehicular Manslaughter
To “recklessly” cause the death of another, the person must have been aware of, and consciously disregarded, a substantial and unjustifiable risk that the result will occur or that the circumstances existed. The risks must be of such a nature and degree that disregard of such risks constitutes a gross deviation from the standard of conduct that a reasonable person would observe in the situation. Normally, a prosecutor will charge someone with Vehicular Manslaughter if they were speeding far above the speed limit and/or if they were drunk or on drugs while driving.

* Vehicular Endangerment
This is usually charged in cases where the prosecutor alleges that the defendant has exhibited an “extreme indifference” to human life while driving. This charge is often used by a prosecutor as a bargaining tool to convince a defendant to plead guilty to Endangerment rather than go to trial on an Aggravated DUI charge.

* Auto Theft
“Auto Theft” occurs when a person controls somebody else’s vehicle with the intent to “permanently” deprive the person of that vehicle. This can occur when a person borrows somebody else’s car for a certain amount of time, but then fails to return it within the agreed upon time period. Also, it can occur when somebody give a material misrepresentation in order to get permission to use somebody’s vehicle.

* Boating DUI and DWI
“Operating or In Actual Physical Control of a Motorized Water Craft While Intoxicated” or “OUI” involves operating a boat, jet ski, SeaDoo, or any other Water Craft while impaired to the slightest degree by the consumption of alcohol, or above a .08% blood alcohol concentration within two (2) hours of operating the water craft. In addition, a person can be “Extreme OUI:” if they are above a .15% blood alcohol concentration within two (2) hours of operating the water craft.

* Hit and Run
“Hit and Run” occurs when a person is involved in an accident (whether it is their fault or not) and they fail to immediately stop the vehicle at the scene, or as close to the accident scene as possible, and exchange information and assistance.

* Drag Racing
“Drag Racing” or “Racing on Highways” occurs when any person drives a vehicle or participates in any manner in a race, speed competition, contest, drag race, acceleration contest, test of physical endurance, or exhibition of speed or acceleration, or to make a speed record on any street or highway.

* Underage Drink and Drive
“Underage Drink and Drive”, it is illegal for any person under the age of twenty-one (21) years to drive or be in actual physical control of a motor vehicle while there is any spirituous liquor in that person’s body.

- Drug Crimes

* Prostitution
One of the strongest defenses to Prostitution is “Entrapment.” Entrapment occurs when an undercover officer who by their actions, induces the defendant to commit the offense, which is something they would not ordinarily agree to do without the actions by the officer. For example, if an undercover police officer utilizes the service of a “private dancer” or “escort”, and then begins offering extremely large amounts of money to induce the dancer or escort into a sex act, and the dancer eventually submits. If the dancer would not have done the sex act without the actions by the officer, Entrapment would be a viable defense.

* Child Molestation
Many times charges for Child Molestation arise during the pendency of a divorce proceeding where the defendant’s soon to be ex-spouse, or an angry teenager who wants her father or step-father “out of the picture”, makes up these false allegations.

* Indecent Exposure
The key to a successful defense to an Indecent Exposure charge is demonstrating that a reasonable person who saw the defendant’s exposure would not be offended or alarmed. For example, most cases involving Indecent Exposure involve adult bookstores, and we would argue that a reasonable witness in the bookstore would not be shocked to see this type of behavior because of the nature of the activities and merchandise that are present in those stores.

* Sexual Abuse
Whether in the Phoenix area, or anywhere in Arizona, per A.R.S §13-1404 “Sexual Abuse” occurs when a person intentionally or knowingly engages in sexual contact with any person who is fifteen (15) or more years of age, without consent of that person, or with any person who is under fifteen (15) years of age if the sexual contact involves only the female breast.

* Sexual Assault
“Sexual Assault”, or “Rape”, occurs when a person intentionally or knowingly engages in sexual intercourse or oral sexual contact with any person without consent of such a person.

* Child Pornography
The crime is committed if any person knowingly records, films, photographs, duplicates, develops, sells, purchases, transports, or electronically transmits or receives any visual depiction of a minor engaged in sexual conduct or exploitive exhibition. This is a very broad statute and covers a wide range of potentially innocent conduct. This particular statute is so broad that a few clicks of a computer mouse while on the Internet can result in being charged with a very serious crime.

* Public Sexual Indecency
“Public Sexual Indecency” occurs when a person “intentionally” or “knowingly” engages in an act of sexual contact, oral sexual contact, sexual intercourse, or bestiality (an act involving contact between a person’s mouth, vulva or genitals and the anus or genitals of an animal) while another person is present, and the defendant is “reckless” about whether the other person, as a reasonable person, would be offended or alarmed by the act.

- White Collar Crimes

* Shoplifting
“Shoplifting” can occur in many different ways when a person enters a shop and knowingly obtains goods of another, with the intent to deprive that person (the shop owner) of those goods.

* Forgery
“Forgery” occurs when a person knowingly completes or alters a written instrument, knowingly possesses a forged instrument, or knowingly offers or presents a forged instrument (whether it is accepted or not). An instrument can still be considered a “forged instrument” even if it has a proper authentic signature, so long as it has a forged amount or other forged material information or alteration.

* Robbery
“Robbery” occurs when in the course of taking the property of another from the alleged victim’s body (or immediate presence) and against their will, the defendant threatens or uses force against any person with the intent to coerce the victim to surrender the property or to prevent the victim from resisting.

* Extortion
“Extortion” occurs by knowingly obtaining or seeking to obtain property or services by means of a future threat to: cause physical injury by means of a deadly weapon or dangerous instrument or some other manner; cause damage to property; engage in other conduct constituting a criminal offense; accuse anyone of a crime or bring criminal charges against anyone; expose a secret or asserted fact (whether true or false) tending to subject anyone to hatred, contempt, or ridicule, or to impair the person’s credit or business; take or withhold action as a public servant or cause a public servant to take or withhold action; or cause anyone to part with any property.

* Money Laundering
“Money Laundering” is one of the most serious of the white collar crimes and is charged in three different degrees of seriousness, each carrying different penalties. The different degrees are most easily explained out of order.

- Crimes Against Property

* Burglary
“Burglary” occurs when a person enters or unlawfully remains on a property with the intent to commit any type of Theft or felony therein. Burglary in the “First Degree” occurs when a person possesses a deadly weapon or dangerous instrument (or an explosive) during the Burglary. Burglary in the “Second Degree” occurs when a person has merely entered a residential structure without a deadly weapon. Burglary in the “Third Degree” occurs when a person has entered a fenced commercial or residential yard, or has made entry into a motor vehicle by means of manipulation of the key or master key.

* Arson
“Arson” occurs when a person knowingly and unlawfully damages a structure or property by knowingly causing a fire or explosion.

* Trespass
“Trespass” is generally when a person knowingly enters or remains unlawfully on a piece of property after they have been requested to leave, or without the expressed permission of the owner, or in violation of a posted sign warning of Trespass.

* Manslaughter
“Manslaughter” by: 1) “recklessly” causing the death of another; 2) “intentionally” or “knowingly” killing a person in the heat of passion or upon a sudden quarrel resulting from adequate provocation from the victim; 3) Intentionally aiding another to commit suicide; or 4) “intentionally” or “knowingly” killing a person while being coerced to do so by the use or threatened immediate use of unlawful deadly physical force upon such person or a third person ,which a reasonable person in his situation would have been unable to resist.

* Kidnapping
“Kidnapping” occurs when a person knowingly restrains another person with the intent to accomplish certain goals including: ransom; shield or hostage; slavery; or to inflict a sexual offense, death, or physical injury to them. Most commonly physical restraint in kidnapping occurs to aid the defendant during the course of commission of a felony (to keep a person from calling the police).

* Child Abuse / Vulnerable Adult Abuse

A “child” is any individual under 18 years of age, and a “vulnerable adult” is any individual who is 18 years of age or older and who is unable to protect himself from abuse, neglect or exploitation by others because of a mental or physical impairment. Child Abuse and Vulnerable Adult Abuse crimes falls in two major categories.

- Computer Crimes

“Computer Tampering”, “Unlawful Possession of an Access Device”, and “Unauthorized Release of Proprietary or Confidential Computer Security Information” are sometimes collectively referred to as “computer crimes.”

- Conspiracy

“Conspiracy” occurs when, with the intent to promote or aide in the commission of an offense, a person agrees with one or more other persons that at least one of them will engage in conduct constituting the offense, and one of the parties commits an overt act in furtherance of the offense.

- Appeals

Just because you have been convicted of a crime does not mean that you have lost your case entirely. There is a Post-Conviction Issues/Appeals process that seeks to overturn your conviction or modify the terms of a sentence. If you have lost civil rights due to a conviction, such as the right to vote, these right can sometimes be restored.
