Areas of Law Description
Our practice includes:
- Personal Injury
* Drunk Driving (DWI) Accidents
Drunk driving accidents—caused by someone who is driving while intoxicated (DWI) —are all too frequent and occur when someone drinks too much alcohol and gets behind the wheel of a car. Judgment is impaired and slowed reflexes may cause the driver to press the gas pedal more slowly than usual, brake slowly, or overcorrect when steering. This can cause a serious accident and injure or kill innocent people. Drunk driving accidents are caused by the negligence of another and the victim may be entitled to monetary compensation.
* Child Injuries
Child injuries are heartbreaking—especially when they occur due to the negligence or carelessness of others. Children may be injured after using defective products such as cribs, strollers, playground equipment and toys. In addition, they may be hurt in car accidents, swimming accidents, and falls. They may also be hurt in a fireworks accident or bitten by a dog. If your child is seriously injured due to the negligence of another party, your family may be entitled to a financial settlement.
* Motor Vehicle Accidents
Motor vehicle accident injuries occur when a car, truck, motorcycle, or some other type of motorized vehicle collides with another motorized vehicle, stationary object, or person. These accidents can be very serious and can cause physical injury or death, emotional trauma, and property damage. Often, motor vehicle accidents are caused by the negligence of one of the drivers. In that case, the injured party may be entitled to damages.
* Dog Bites and Animal Attacks
Dog bite injuries can very serious and can cause pain, infection, disfigurement, emotional trauma, and even death. Victims are often injured by dogs they know—those of family, friends, and neighbors. They may also be attacked and injured by loose or stray dogs. Owners are responsible for their pets and victims injured by a vicious dog may be entitled to monetary damages.
* Head Injury and Brain Damage
Head injuries are serious personal injuries that can occur in any number of ways—especially motor vehicle accidents, pedestrian and bike accidents, swimming accidents, and playground accidents. Head injuries may result in serious, life-altering conditions such as concussion, coma, mild traumatic brain injury or severe brain injury. Victims may be entitled to a monetary settlement if the injury was caused by the negligence of another party.
* Defective Products
Consumers rely on the safety of the products they purchase and use. Defective products are those that cause a serious health problem or injury to the user—even when used as recommended. Defective products may include baby products, toys, electronics, medication, medical devices, automobiles, household appliances, and a multitude of other items. The manufacturer, seller, or distributor may be held liable for damages due to defective products.
* Car Accidents
Car accident injuries occur when a car collides with another motorized vehicle, stationary object, or person. These accidents can be very serious and may cause physical injury or death, emotional trauma, and property damage. Often, car accidents are caused by the negligence of one of the drivers. In that case, the injured party may be entitled to damages.
* Serious Injury and Catastrophic Accidents
Serious injuries such as a blow to the head, spinal cord damage, severe burns, or extreme blunt force trauma threaten life and cause physical damage that may last a lifetime. Catastrophic accidents are severe accidents that often result in a serious injury. These types of accidents and injuries can occur in a variety of ways such as being hit by a drunk driver, being involved in a car accident, an injury caused by a defective product, or an injury caused by a dog attack. Victims of these accidents or injuries may be entitled to a financial settlement if the accident or injury was caused by the negligence of another.
* Wrongful Death
Wrongful death may result from a wide variety of accidents and injuries. However, one thing is certain—losing a spouse, child, family member, or friend to a wrongful death is a nightmare. Survivors are emotionally traumatized by the loss of a loved one and financially devastated due to medical bills, funeral costs, and the decedent’s lost wages. When a family member dies because of carelessness or negligence on the part of another, surviving family members may make a legal claim for damages that may include lost earnings, medical expenses, and funeral expenses, in addition to other damages.
* Back and Spinal Cord Injuries
Back and spinal cord injuries can result from almost any accident and can permanently alter the life of the victim. Back injuries may be painful and have long-lasting or even permanent affects. Spinal cord injuries, which result from blunt force trauma to the spine, may cause pain, incontinence, or paralysis. These injuries are serious and life altering. If the injury was caused by the negligence of someone else, the victim may be eligible for damages including medical bills, lost work, and pain and suffering.
* Semi-Truck Accidents
Semi-Truck accident injuries occur when a truck collides with another motor vehicle, stationery object, or pedestrian. Trucks are extremely heavy and can cause great damage when they hit a smaller vehicle—especially to the people inside. If the accident occurred because of negligence on the part of the truck driver, victims may sue for damages to compensate them for damages such as medical bills, lost wages, and pain and suffering.
* Negligence
Many serious injuries are caused by negligence—the failure to exercise proper care to prevent and accident or injury to another party. Almost any accident or injury can be the result of negligence including drunk driving (DWI) accidents, motor vehicle accidents, child injuries, injuries occurring due to a defective product, dog bites, head injuries, and spinal cord injuries. When a party is negligent, the victim may seek legal recourse for damages including medical bills, lost wages, and pain and suffering.
* Pedestrian and Bicycle Accidents
Pedestrian and bicycle accidents occur when a pedestrian or bicyclist is struck by a motor vehicle. Neither the pedestrian nor the bicyclist has much protection against the impact from a motor vehicle. In addition, they may be seriously injured by impact with the ground or other stationery objects. Many times, a distracted or careless driver causes these accidents. Negligent drivers may be sued for damages including medical bills, lost wages, and pain and suffering.
* Motorcycle Accidents
Motorcycle accidents occur when a motorcycle is hit by a motor vehicle. Motorcyclists have little protection against the impact of a motor vehicle. The rider may be severely injured by the impact with the motor vehicle as well as by impact with the road and other nearby objects. If the accident was caused by the negligence of the other driver, the motorcyclist may be entitled to monetary damages.
* Boating Accidents
Boating accidents can occur anywhere where boaters take to the water. Many accidents happen on lakes and rivers where people are boating, fishing, waterskiing, tubing, swimming, and riding on jet skis. Collisions between boats, personal watercraft, and people in the water can cause severe injuries and even death. If a boating accident happens because of the negligence of a boater, the victim may be eligible to collect monetary damages to cover medical bills, lost work, and pain and suffering.
- Family Law
* Divorce
Dissolution of a marriage is a very stressful event—especially when children are involved. With it comes a whole host of emotions including anger, guilt, sadness, and uncertainty. Many people spend a fortune to obtain a divorce because they fight about every detail. It is important to recognize that most divorces have a predictable outcome. You can spend a great deal of money on a contentions divorce that leaves you emotionally and financially drained at the end. Alternatively, you can work rationally and cooperatively together to dissolve the marriage, divide the assets fairly, and take care of the children with a reasonable custody agreement—without spending a fortune. The Todd Law Firm promotes this second approach and calls it the Dignified Divorce.
* Child Custody
When a divorce involves children, both parents may have questions about who will have custody of the children, where they will live, how visitation will work, and how child support is determined. Reasonable people want what is best for the children. However, there are situations where parents do not agree on the right approach for custody. In addition, one parent may have serious reservations about the other parent obtaining custody. In these situations, it is best to obtain the services of a skilled family lawyer at the Todd Law Firm to protect your interests.
* Modification of Orders
Parents often request post-divorce modifications to custody, visitation, spousal support, and child support orders. Many times, these changes are prompted by major life events such as loss of a job, increased wages for either spouse, or remarriage of the spouse who receives spousal support. The Todd Law Firm can discuss the modification with you to determine the feasibility and cost effectiveness of the change.
* Adoption
There are many different ways to adopt a child including agency adoptions, independent adoptions, identified adoptions, and international adoptions. There are other types of adoptions including adoptions by same sex couples, relative (kinship) adoptions, stepparent adoptions, and adult adoptions. While adopting a child is a happy event for a family, the legal aspects can be confusing and it is best to obtain the services of a skilled family lawyer at the Todd Law Firm to complete the process.
* Child Support
Child support—the way financial responsibilities for the children are divided by the parents— is determined at the time of the divorce. Child support generally means paying for health insurance, a portion of uninsured healthcare expenses, and a fixed dollar amount to house, clothe, and feed the child. Child support generally depends on the custody arrangement. It is best to obtain the services of a skilled family lawyer at the Todd Law Firm in order to protect your interests and ensure the best outcome for your child.
* Assault and Other Torts in Divorce
The legal dissolution of a marriage can be very stressful and contentious. It is especially difficult when one spouse assaults another or commits a tort—behavior that caused the spouse to suffer loss or harm—such as hiding assets. The Todd Law firm can work to make sure these wrongs are addressed as part of the divorce.
