- Chapter 7 Bankruptcy

A Chapter 7 bankruptcy, also called a straight bankruptcy, is a liquidation proceeding. To begin a Chapter 7 case you must file a petition, schedules and statement of financial affairs with the Bankruptcy Court. The Court will appoint a bankruptcy trustee to oversee your case. All non-exempt property must be turned over to the bankruptcy trustee who will then convert it to cash for distribution to the creditors. You can keep all exempt property, which is determined by the laws of the state of Ohio. In the vast majority of cases there are no assets, so a Chapter 7 will give that person a relatively quick "fresh start".

- Chapter 13 Bankruptcy

Chapter 13 bankruptcy filing is a way for individuals to undergo a financial reorganization supervised by a federal bankruptcy court. The Bankruptcy Code anticipates the goal of Chapter 13 as enabling income-receiving debtors a debtor rehabilitation provided they fulfill a court-approved plan.

- Predatory Lending

There are a number of different forms that predatory lending takes. In each instance, however, a financial institution takes unfair advantage of a consumer’s financial needs by charging usurious interest rates and other unconscionable fees and charges. Predatory mortgage lending involves a wide array of abusive practices.

- Estate Planning / Probate

While nobody wants to think about death or disability, establishing an estate plan is one of the most important steps you can take to protect yourself and your loved ones. Proper estate planning not only puts you in charge of your finances, but it can also spare your loved ones of the expense, delay and frustration associated with managing your affairs when you pass away or become disabled.

When a loved one passes away, his or her estate often goes through a court-managed process called probate or estate administration where the assets of the deceased are managed and distributed. The length of time needed to complete the probate of an estate depends on the size and complexity of the estate and the local rules and schedule of the probate court.

- Family Law

Our firm assists clients in all aspects of family law including the following: Divorce/matrimonial law; Child custody and visitation schedules; Alimony; Domestic violence restraining orders; Modification of child support; Prenuptial agreements; Mediation; and Adoption.

- Mortgage Modifications

If you can afford to make a mortgage payment going forward (even if it's not a full mortgage payment), a loan modification and a mortgage pay rate reduction is a possibility. A loan modification involves demonstrating to the lender that a temporary situation caused the borrower to fall behind on the payments, but that the situation has been resolved completely and the borrower is eligible for a mortgage rate reduction. A loan modification typically requires proof that the borrower earns enough household income each month to make a mortgage payment.
