Attorney Timothy Kennedy maximizes your settlement by preparing all of his files as if he is going to trial. For this reason, and because of Mr. Kennedy's fierce reputation among insurance adjusters and defense attorneys, most of his cases reach full value settlements without needing to go to trial. When the Law offices of Timothy Kennedy lays its cards on the table, showing the winning hand we have created by vigilantly pursuing the legal rights of our clients, the big insurers often see that they have no choice but to fold. That means a top dollar settlement to you.The goal in a personal injury claim is to maximize the settlement or award to best compensate our clients for the losses, pain and suffering that come from an accident caused by negligence, or from a work injury. If scrupulously professional preparation of your claim and aggressive pre-trial representation by Mr. Kennedy fail to force a truly full value settlement, a top dollar settlement, from the involved insurance company or companies, we are prepared to fight on and fight hard to pursue your case through trial and decision. We present trial testimony from fact witnesses and expert witnesses in a manner that is clear and compelling to jurors and judges, and we cross examine opposing witnesses and experts ruthlessly and intelligently, to leave you with the strongest possible case and to secure for you the best possible award at trial, if not a full value settlement in the courthouse corridors.
Unlike some lawyers you may have talked to or dealt with in the past, we never forget that we work for you, not the other way around. We make it easy for you. We keep you advised of what is going on in your case, by sending you copies of every letter we sent out, by calling you with updates periodically, and by promptly responding to every telephone call and e-mail we receive. We also make it easy for you with three convenient locations to meet with you: in Havertown, Delaware County, just off the Blue Route; in Center City Philadelphia just one block from City Hall, convenient to Suburban Station, other mass transit and inexpensive parking; and in beautiful Blue Bell, Pennsylvania, in the heart of Montgomery County.
Our careful and aggressive case management means that the vast majority of cases are settled quickly, for full value, without the delay and expense of litigation or trial: but when we do go to trial, we walk into the courtroom prepared, so that our clients can walk out happy.

Areas of Law Description
Attorney Timothy Kennedy provides legal representation and services in all areas of personal injury, including:
- Workers' Compensation
If you have been hurt at work in Pennsylvania and you are considering a claim for workers' compensation, or you have already made a claim, you will eventually need an attorney. However, you sure don't want to be paying an attorney when your right to benefits might not be at risk. You need experienced legal advice as early as possible. Call attorney Tim Kennedy.
Heart and Lung Act
The Pennsylvania Heart and Lung Act is closely related to the Pennsylvania Workers Compensation Act in its application, but provides significantly more generous benefits to those who fall under its protection. It grants full compensation as well as continuation of employee benefits to eligible employees who are "injured in the performance of [their] duties." It is not necessary that the injury involve the heart or the lungs in any way.
Insurance Abuses
Typical abuses by insurance companies in workers compensation cases include failing to timely issue a formal acceptance or denial of your claim, understating your wages and compensation rate, using an artificially limited description of your injury, failing to comply with time deadlines for paying compensation benefits, sending late workers comp checks when you are on benefits, and using inappropriate bureau forms to acknowledge or document your injury such that your important rights regarding the injury may be prejudiced immediately or in the future.
Employers Abuses
Typical abuses by employers in handling work injury claims include failing to report your claim to insurance carriers, understating your wages, improperly steering injured workers to a specific company doctor over whom they have influence or control, pressuring injured workers back to work before they are ready and failing to fully honor light duty restrictions set by a doctor. Some employers will even try to convince employees to accept lay-offs with unemployment benefits or other disability payments instead of workers' compensation benefits. This will profoundly compromise the injured workers' rights.
- Motor Vehicle Accidents
Attorney Timothy Kennedy is one of those Philadelphia motor vehicle accident lawyers who take every case seriously. When your neck is in such painful spasm that you can't tolerate working, looking at a computer or the head turning motions necessary to safely drive home from your doctors' appointments, you know first-hand there is no such thing as a "minor" whiplash injury. The back strains and sprains victims often suffer in even low impact motor vehicle accidents can be extremely painful, disabling and hugely disruptive to a previously active lifestyle. Attorney Tim Kennedy understands this, and he treats all of these cases very seriously. More importantly, Tim uses all of the best practices of his sixteen years of experience to build every case in such a way that the defendant insurance adjuster and any involved defense attorneys will also be forced to take your case seriously, so that your settlement will be maximized and you will get the compensation your injuries deserve.
Car Accidents
When you've been injured in a car accident, legal issues arise immediately, whether or not you have a lawyer. Insurance carriers for both drivers, or in some cases, multiple drivers, may want formal statements to determine who is at fault or who had the right of way. Questions of insurance coverage arise right at the scene, and may carry over into a legal dispute.
Motorcycle Accidents
Tim Kennedy is a motorcycle accident lawyer who recognizes the special risks faced by motorcyclists on our roads, and the unique prejudices that are sometimes present among jurors, insurers adjusters, and at times even police officers charged with accident scene investigation or reporting. Negligent drivers who fail to be attentive to the smaller profile of a motorcycle, or who cut off a cyclist as if he were not there and create an unavoidable accident, often swear that the motorcyclist was at fault -- as if the bike came out of nowhere, when it was there all along. The fact is, no matter how careful you are on your bike, the negligence and inattention of other drivers who are unprepared to share the road with you will place you at risk every time you take to the highway.
Truck Accidents
Several important legal considerations come into play when you are involved in an accident with a commercial truck, such as a tractor-trailer. Most of these simply don't apply to the more common cases of accidents with other vehicles.
Bus Accidents
Bus accident statistics make it obvious that our Pennsylvania bus operators need to do a much better job to make safety a top priority. Both school districts and municipal mass transit systems are often underfunded, or poorly managed, to the point where they cut corners with the safety of their buses or the quality of their drivers. Bus accidents result from many causes, including driver negligence, defective equipment, dangerous roadways and improper maintenance. These factors can give rise to liability in the event you have been injured in an accident involving a bus.
Bicycle Accidents
Bicycle riding has a higher death rate per trip or per mile of travel than being a passenger in a car. Nine out of ten bicycle related deaths are from collisions involving motor vehicles. Despite the rise in the use of bicycle helmets, the majority of these deaths are caused by head injuries. In contrast, only one out of ten nonfatal injuries comes from a bicycle versus motor vehicle accident. The statistics prove the obvious: when a bike and a car come together, the bike loses, and the injuries are very serious and often fatal.
Train Accidents
Trains are impressive and imposing machines. When a train is involved in a collision, the injuries are often very severe or fatal. Survivors may be left with devastating brain or spinal cord injuries. The number of fatalities arising from train vs. car collisions for the most recent year for which statistics are available was 174 deaths in the United States alone. This is a far higher death rate from such accidents than seen in any other advanced country, possibly reflecting the poor priority placed on our railroad infrastructure, the vast number of unimproved railroad crossings which force cars and trains to share intersections, and the sometimes poor performance by railroad companies who fail to abide by basic safety regulations.
Pedestrian Accidents
Pedestrians are at grave risk for serious injury when struck by a vehicle or otherwise injured as a result of driver negligence. Nearly 70,000 people per year suffer injuries as pedestrians, and nearly 5,000 of those injuries every year are fatal. The vast majority of those deadly pedestrian accidents occur in urban areas. A very large number of those killed as pedestrians are children. Very frequently, the speed of the vehicle involved is the deciding factor in whether the pedestrian who is struck will live or die.
Rear End Accidents
If you've suffered injury due to a rear-end collision, you have rights. Rear-end collisions are among the most common vehicle accidents and are usually caused by the inattention of the liable driver approaching cars stopped in traffic or at an intersection. However, at times such collisions are caused by the sudden stop of the car ahead, sometimes resulting in injuries to occupants of either or both cars.
Head on Collisions
Head on auto accident collisions result in dramatic vehicle damage and often very serious personal injuries and even fatalities. Serious resulting injuries may include head injuries, brain injuries, spinal cord injuries and very serious orthopedic and musculoskeletal injuries. Even relatively low-speed head-on collisions transfer tremendous force from the impact to the occupants involved in the car accident or truck accident.
Side Impact Collisions
If you've suffered injury due to a side impact collision, you have rights. Side impact car crashes frequently occur at intersections. Often liability is disputed. You need an experienced personal injury lawyer to protect and advance your rights.
Rollover Accidents
SUV rollover accidents are among the most deadly and dangerous accidents because they tend to occur at significant speeds and because the forces imparted by a roll-over frequently cause vehicle roofs to collapse upon the occupants. The lack of substantial safety features to take these kinds of forces, combined with the high centers of gravity in an SUV, can combine with other unsafe conditions on our roadways to place passengers and drivers at serious risk.
Intersection Accidents
Motor vehicle accidents at street corners or intersections often result in liability disputes. Both parties claim to have had the right of way, and insist the other driver was at fault. At times there is a red light dispute, or an argument involving other traffic controls. There may even be conflicting witness statements.
Road Design and Defects
Unsafe roads and poorly maintained highways are a danger for every driver. Many accidents are caused by road defects that make the road itself a hazard, with no other negligence involved. Other accidents are contributed to by an unsafe roadway, in combination with a negligent driver whose actions, together with the condition of the road, put others on the roadway at risk.
Negligence
If you've suffered injury due to a motor vehicle accident caused by the negligence of another driver, those responsible for maintaining safe roadway conditions, or any other person or entity whose carelessness, inattention or negligence results in harm, you need to protect and advance your rights. You should not suffer in silence for the sake of saving an insurance company the money you are otherwise due as compensation for the trauma and aggravation of an injury and the other hardships and aggravation that come with a motor vehicle accident.
Uninsured Motorists
If you've suffered injury due to a Pennsylvania MVA, and the negligent driver was uninsured, or the negligent party simply cannot be found or identified, you may be able to recover against your own insurance policy, in an amount equal to the liability of the negligent party, up to the limit of any available uninsured motorist coverage. In fact, an uninsured motorist (UM) claim may even present some procedural advantages over pursuing the claim directly against the negligent party. Alternately, you may qualify to make a claim against the Assigned Risk Plan, another potential source of recovery where there is no insurance coverage otherwise available.
- Wrongful Death
If your loved one has been killed in an accident or otherwise due to negligence, carelessness or recklessness, call Attorney Tim Kennedy, a Philadelphia attorney with experience representing the spouses and families of wrongful death victims. In some cases, a defendant may be strictly liable for the accident, injury or event resulting in the death, even in the absence of negligence. Tim Kennedy is an experienced trial attorney who knows you need much more than a shoulder to cry on -- you need a lawyer who can help bring you justice for your excruciating loss. Unfortunately, you cannot afford to wait to pursue your claim on behalf of a lost loved one, no matter how badly you may want the world to just stop after a devastating loss. Delay in contacting a skilled attorney could lead to loss of evidence, missed statutory deadlines, or other prejudice to your claims.
- Brain Damage / Brain Injuries
I have come to know and respect persons whose lives have been shattered by a traumatic brain injury. Persons who remain intelligent, thoughtful, insightful and creative -- but for whom something has been lost. From whom something has been taken. For whom life is now a struggle, as never it was before. I have also known some sufferers of head trauma who are, no longer, any of those things. Those who now depend upon others, or on machines, to maintain their beating hearts. Whose skulls have been misshapen by blunt trauma and by surgery. Those who will never rise or walk again despite legs that would otherwise be fully willing, if only the brain could will it. Victims who suffer brain damage often suffer bitterly. Don't be victimized twice. Get what you deserve.
- Spinal Cord Injuries
Spinal cord injuries are hugely life affecting. You need to depend on a lawyer who will make the commitment to fight for your needs. To get you every bit of help, every device, aid or service, you need and deserve to allow you to persevere after the grave trauma of a spinal cord injury, over and above the absolute full value recovery for your pain and suffering. Call us and speak with Attorney Tim Kennedy personally. With sixteen years of hard-hitting litigation experience in Philadelphia and its surrounding counties, Tim knows how to protect and advance the rights of victims of serious injuries in Pennsylvania.
- Paralysis / Paraplegia
Paralyzing injuries turn lives upside down. Such injuries profoundly alter the life of the injured person and the lives of all of those who love him or her. Victims of paralysis and their families need to know they can depend upon a lawyer who will make the commitment -- often a lifelong commitment - to fight for what is right and fight for what is necessary.
- Burn Injuries
Often, burn injuries are disfiguring. The deeply regrettable truth is that scarring from burn injuries can range from the unsightly to the grotesque. Burn injury victims must live with the pain and suffering caused by this every day. Some persons who have suffered facial burns find it hard to function in society or even to appear in public. The reactions of passersby are simply too painful. This too is a form of pain and suffering which must appropriately be fully recognized when pain and suffering damages are awarded for burn injury victims.
- Electrical Shocks
Electrical shock injuries are unfortunately quite common. Injuries may be fatal or catastrophic, or may appear mild yet have long-reaching effects. Often, the psychological trauma that accompanies such injuries is as much a factor for recovering victims as the physical effects of the electrical shock. You need a lawyer who understands these cases and how to prove your damages in a way that is compelling at the settlement table, or, if necessary, in the courtroom. When looking for an electrical shock injury lawyer in the Philadelphia area, call Tim Kennedy first. He will explain your rights and detail for you the steps he will take to get you the maximum recovery possible.
- Premises Liability
Store owners, building owners, landlords and homeowners have a legal responsibility to keep their premises safe for others. Negligent maintenance of the property, allowing hazardous conditions or slipping hazards, or failing to provide appropriate security for a property can all be grounds for liability where such negligence causes a visitor to suffer injury. The Law Offices of Timothy Kennedy treats injuries due to unsafe conditions on property with the seriousness these injuries deserve. We know how to gather and present the evidence to prove your claim and maximize your recovery. Call us today for aggressive representation and immediate advice.
- Slip and Fall
If you have been the victim of a slip and fall injury in Pennsylvania caused by a hazardous condition that had not been made safe, you have rights under Pennsylvania law. The Law Offices of Timothy Kennedy can help you to enforce those rights so that you may recover money damages for any pain and suffering you have experienced due to a slip and fall, trip and fall, or other fall or injury caused by unsafe conditions on property.
- Defective Products
If you or a loved one has suffered an injury requiring substantial medical treatment as a result of dangerous defect in a product, machine or other consumer item, you have rights! Importers who bring into our country for sale items that are improperly made and dangerous in their use may be held liable in a civil action. Manufactures who cut corners to save on costs, at grave risk to public safety, may be held accountable.
- Dog Attack / Dog Bites
Being attacked by a dog or other animal is a traumatic experience. Dogs in the wild are predatory animals. When a dog with violent instincts turns on human, very bad things can happen. Facial scars, ragged lacerations, deep and painful wounds, and substantial psychological trauma may be the result of an attack when a violent or volatile animal is not adequately kept under control. If you or someone you know has suffered injury from a dog attack or dog bite, call the Law offices of Timothy Kennedy now. Owners of dogs and other animals have an obligation to keep the public safe from the aggressive or dangerous behavior of their animals.
