- IRS Tax Audit
The goal of an IRS audit is to verify that income, information, expenses and deductions were accurately reported to the IRS on a taxpayer’s tax return. An audit can result in the IRS assessing additional taxes, interest and penalties. Even worse, a seemingly innocuous audit may result in criminal prosecution. This is referred to as an “Egg Shell Audit.” With so much at stake, it is easy to see why an audit can cause serious anxiety.
- Innocent Spouse Relief
The IRS is aware that an “innocent spouse” may be helplessly embroiled in his or her spouse’s tax issues. If one of the spouses who signs the joint tax return does not believe he or she should be liable for the full amount of the taxes, that spouse may seek relief from liability under the innocent spouse rules.
- Bankruptcy
Many, including tax professionals and bankruptcy attorneys, believe that bankruptcy cannot discharge taxes. While the intersection of bankruptcy and tax laws, including the application of tax liens and levies, are complex, the assertion is not true. Bankruptcy can discharge taxes and is often a powerful weapon for handling back taxes. Additionally, unlike an offer in compromise or an installment agreement, bankruptcy can resolve nontax liabilities.
- Audit Reconsideration Request

- Installment Agreement
Installment agreements provide a way to pay what you owe to the IRS through monthly payments. For many taxpayers with large back tax bills, paying what is owed at one time is simply not possible. Installment agreements make payments more manageable and can be a viable alternative if you do not qualify for an offer in compromise or other tax liability relief.
- Wage Garnishment
A wage garnishment occurs when the IRS notifies your employer to withhold your paycheck in order to collect your past-due tax debt. Your employer will then be legally bound to send a portion of each paycheck to the IRS. In addition to a wage garnishment, the IRS has the ability to levy 15% of your monthly Social Security benefit payments to pay any delinquent taxes.
- Bank Levy
An IRS bank levy is an order directing your depository to seize all the funds in your account and transfer them to the IRS. Upon receipt of the order, the bank holds the money in escrow for 21 days from the date of the levy. Upon the expiration of the 21 day period, the bank will send your money to the IRS.
- Penalty Abatement
For many, the tax owed is not the problem, but rather, it’s the penalties and interest that continue to accrue daily. IRS penalties and interest can cause a seemingly insignificant tax liability to soar out of control. Most people wait too long to address the issue and find themselves in a hole that is too big to dig themselves out of. When this happens, the best thing to do is to hire a tax attorney to assist with what’s called “an abatement of penalties.” An abatement of penalties, requests the IRS to eliminate certain penalties on a taxpayer’s account.
- Payroll Tax Issues
When you run a business that pays employees, whether it is a small business or a large corporation, you must deal with payroll taxes. You’ll probably be filing a quarterly federal tax return, otherwise known as a 941 Return, and an annual Federal Unemployment (FUTA) Tax Return (940 Return). The IRS requires you to collect and pay taxes that are withheld from your employees’ wages. These taxes, along with your personal Social Security tax, are collected and to be held in trust until you pay the IRS. They are referred to as “withholding taxes” or “trust fund taxes.”
