Areas of Law Description

- Personal Injury

A personal injury case can include a variety of situations including traffic collision injuries, slip and fall injuries, injuries suffered because of a medical mistake by a doctor or a legal mistake by a lawyer. It can also include injuries that occur because of a defective product or in the course of work such as on a construction site. In order to make a case, the injured person must be able to show that the harm and losses were caused by someone else's carelessness. Personal injury claims typically involve physical injuries that are often accompanied to some degree with emotional upset.

- Wrongful Death

Wrongful death occurs if the death of a loved one was caused by someone's "wrongful conduct", such as by medical malpractice, a motor vehicle collision, construction injury, or defective product. Immediate family members of the deceased can seek compensation for their losses. Wrongful death may result in financial difficulties resulting from lost income and medical expenses. The law also allows you to recover for emotional losses, including loss of companionship, love, and affection. Recovery for these damages may include both past and future losses. The lawyers at Tremont & Sheldon have been able to recover significant compensation for their clients in wrongful death lawsuits.

- Legal Malpractice

The Connecticut malpractice attorneys at Tremont & Sheldon are skilled in handling legal malpractice cases. A number of years ago our firm had to decide if we would be one of the few law firms in the state of Connecticut to bring claims on behalf of persons who were financially damaged by an attorney's neglect or dishonesty. We concluded that it would be hypocritical of us to require doctors, motorists, and manufacturers to follow the law, but allow lawyers to break the law and get away with it.

- Medical Malpractice

Medical malpractice occurs when medical providers fail to follow the safety standards and rules of the medical profession and as a result the patient suffers harm and losses. Medical malpractice cases always require expert testimony from a medical provider to prove that safety standards and rules have been broken and to prove that the patient has been harmed as result. Medical malpractice cases can be brought against doctors, nurses, hospitals, and nursing homes.

- Defective Medical Products

When a medical product is not manufactured properly, it can lead to serious consequences for patients. With an extensive background in medical malpractice, our personal injury attorneys advise clients on lawsuits related to defective medical products. We investigate injuries or medical problems that may have arisen due to medical malpractice by a doctor, nurse, or other health care professional, as well as defects in medical products or surgical equipment. Recent investigations into medical equipment manufacturers have included problems related to hip and joint replacements or prescription drugs.

- Nursing Home Negligence

The personal injury attorneys at Tremont & Sheldon handle cases for those individuals who have been injured at a nursing home by negligence or abuse. Victims of nursing home abuse are often elderly and unable to speak up or care for themselves. Nursing home cases often involve claims of neglect or abuse where the frailest among us suffer because of inadequate and/or improper care. As a result, serious, and sometimes fatal, injuries can incur involving decubitus ulcers (bed sores); dehydration (lack of body fluids); malnutrition (improper diet), and falls due to lack of supervision.

- Motor Vehicle Accident

Our law firm has been protecting the rights of people injured in car, truck, and motorcycle accidents for more than 50 years. We understand that after you have been injured in a car accident, you can quickly find yourself with more questions than answers. We’re here to help. We carefully monitor all aspects of your case and review the details with our medical experts to get you best possible recovery. Our track record is impressive, with millions of dollars for our clients over the years. Most importantly, we always take the time to get to know our clients, to uncover all of the facts, and to give you a realistic idea of what to expect.

- Workplace Injuries

Most employers are required to provide workers’ compensation coverage. The injured worker is able to make a claim for payment of medical expenses and can also receive partial payment for lost time from work. The coverage provides for both temporary and permanent disability benefits. For most workplace accidents, workers' compensation insurance provides the sole means of recovery. However, when the accident is caused by the fault of someone other than the employer or a fellow employee, the injured worker may have a right to sue in court.

- Car & Truck Accidents

Often, car and truck accident cases that appear minor at first can prove to be more serious. We encourage you to speak to an attorney before talking to insurance companies, who may not have your best interests at heart. You want someone who knows the law and knows how to handle car accident cases in Connecticut. The car accident lawyers at Tremont & Sheldon have experience recovering millions of dollars on behalf of clients who have been injured in car accidents. For more than 50 years, we have investigated the facts of each case and advocated for the best possible results for our clients.

- Motorcycle Accidents

The law firm of Tremont & Sheldon won the largest motorcycle accident verdict in Connecticut’s history – more than $2 million – for a client who was injured by a bus in a motorcycle accident. Through accident reconstruction, our attorneys proved that the motorcycle accident was not the biker’s fault. Medical experts testified about his injuries, and after a three-week trial, a jury found the bus company completely at fault for the accident.

- Drunk Driving Accidents

People who are hurt by drunk drivers have the right to make a claim against the driver, as well as possible claims filed under the Dram Shop law. In the last few years, the state of Connecticut has toughened the laws that regulate bars and restaurants that serve alcohol. If a bar or restaurant serves alcohol to an intoxicated person who then causes an accident, the bar or restaurant can be held responsible.

- Hit and Run Pedestrian Accidents

Pedestrians hit by car and trucks often don’t believe that they have the same rights as drivers. Tremont & Sheldon has experience working with hit and run accident victims – pedestrians who were struck by cars or trucks who left the scene of the accident. The firm has also recovered money for bicyclists who were hit by cars. We have earned a reputation for holding reckless drivers accountable for their carelessness.

- Uninsured Motorists

Some of our clients wonder what they can do if they were in a car accident with someone who either wasn’t insured or didn’t have enough insurance to cover the cost of the damages they caused. There are still other options to pursue, and our attorneys will help you explore all of your options to cover the cost of your medical care and other damages. The law requires car insurance policies to provide coverage to their insurers if another driver who does not have enough insurance or does not have any insurance causes them injury. In those situations, you can make a claim against your own insurance company for harm and losses suffered. The amount of damages that can be claimed is limited by the amount of uninsured/underinsured coverage purchased.

- Distracted Driving

Driving while distracted poses a great danger to the driver and everyone in his or her path. Our attorneys are seeing an increasing number of cases caused by distracted driving. We have the experience to investigate distracted driving cases and hold drivers accountable for their actions. We encourage victims of distracted drivers to come forward and prevent similar accidents from happening to others.

- Defective Products

You are surrounded by mechanical, electrical, and chemical products from the moment you wake up and use an electric hair dryer, a toaster oven, or coffee pot; or you use your electric garage door opener or drive in your car to your office. If you are injured by a product, the first step is to secure the actual product that caused the injury. Call us immediately after the accident, and we can have the product completely inspected or analyzed by an engineer to determine the cause of the accident.

- Falls

The personal injury attorneys at Tremont & Sheldon handle all types of premises liability cases (otherwise known as falls or slip and falls) throughout the state of Connecticut. Premises liability cases can include slips and falls on private or public property as a result of a hazardous condition. Slip and falls include injury as a result of ice, snow, or water. Slip and falls can also occur with changes in flooring, dim lighting, or an unseen hazard, such as a hole or raised surface. Many people suffer injuries in supermarkets or shops, falling on wet floors or tripping over objects that should not be there.

- Security Issues

Security issues are another form of premises liability. Security issue premises liability can include, but is not limited to, attacks or accidents reflecting inadequate security in apartment buildings, parking garages, or other property. When these accidents occur, the public or private property owner could be legally responsible for monetary compensation. Businesses in Connecticut have a responsibility to take reasonable steps to protect the public and their customers from crime. Unfortunately, we all know that people visiting businesses such as stores, restaurants, and residential complexes can be targeted by criminals.

- Spinal Cord Injuries

Sadly over the years, the lawyers at Tremont & Sheldon have represented clients with spinal cord injuries including paraplegics and quadriplegics. These injuries can occur from motor vehicle accidents, swimming pool accidents, police chases, medical mistakes, and other unfortunate circumstances. The attorneys at Tremont & Sheldon have a great amount of experience and expertise in representing clients with these types of spinal cord injuries and are able to bring together a team of experts to develop a long-term plan that meets the unique needs of the individual and his or her family/caregivers.

- Liquor Liability

Bars and restaurants have an obligation when they serve alcohol to a customer to make sure that they do not serve that customer to the point of intoxication. We all know, including the owners of the bars and restaurants, the tragic consequences of drunk driving. Therefore, if a bar or restaurant does “over-serve” a customer who then goes out and causes an accident, that seller of alcohol can be held responsible for the injuries caused by the drunk driver.

- Dog Bites

Keepers of animals have a duty to use reasonable care to keep their animals from hurting people. While this obligation applies to all animals, most commonly we see people being injured as a result of an attack by a dog. There are special laws addressing injuries caused by dogs which entitle injured victims to compensation. It is against the law to allow a dog to roam freely and not under control of the owner or keeper. If a dog bites, or even knocks down a person, the owner of the dog can be held responsible for the injuries that are caused. Further, the owner or keeper of the dog is liable for any injuries caused by a dog as long as the victim is not trespassing or teasing the dog. If a dog is involved in your injury, always identify its owner or license.

- Sexual Abuse

These kinds of claims include situations where an adult sexually assaults a child or shows a child pornography or takes inappropriate photographs of a child. It often involves inappropriate and sexual contact such as fondling, kissing, and digital penetration. Tragically, the perpetrators of these acts are often people who are well known to the victim such as a clergy member, teacher, friend of the family, or even family member.

- Church Abuse

The personal injury law firm of Tremont & Sheldon was one of the first law firms in the nation to file lawsuits for sexual abuse against clergy members. We have helped to bring this sensitive topic to the forefront and have argued in the legislature for a longer statute of limitations, now giving victims until the age of 48 to bring claims in court.

- Hospital Abuse

Few legal cases have garnered as much Connecticut media attention as the case against Dr. George Reardon, a physician at St. Francis Hospital in Hartford, who sexually abused countless children. Dr. Reardon practiced medicine as an endocrinologist at St. Francis Hospital for almost 40 years. Over the course of his career, hundreds of children were seen in his offices to participate in what Dr. Reardon described to be a growth study. It was only in 2007 that Dr. Reardon's growth study was discovered to actually be a cover up for a massive child pornography enterprise.

- Abuse in Schools

Every child in America has the right to a good education. We, as parents, trust that the teachers and staff at the schools our children attend have the best interests of our kids in mind. Almost always that is in fact the case. Tragically, however, there are a few educators who have violated this trust and have sexually assaulted children. When that occurs, not only must the teacher be held responsible but also the school if it allowed the abuse to occur. We have settled a number of cases against private, parochial, and public schools and are actively pursuing a case against a public high school.

- Mandated Reporters

Under Connecticut law, the following people are mandated reporters of suspected child abuse: doctors, nurses, medical examiners, dentists, dental hygienists, psychologists, coaches, school teachers, school principals, school guidance counselors, school paraprofessionals, social workers, police officers, juvenile or adult probation and /or parole officers, members of the clergy, pharmacists, physical therapists, optometrists, chiropractors, podiatrists, mental health professionals, physician's assistants, certified EMT providers, certified drug and alcohol counselors, licensed marital and family therapists, sexual assault and/or battered women's counselors, paid child care providers in public or private facilities, child day care centers, licensed group and /or family day care centers, employees of the Department of Children and Families or the Department of Public Health if responsible for licensing day care centers homes or youth camps or the Office of Child Advocate and the Child Advocate.
