Probate is defined as the process that transfers legal title of property from the estate of the person who has died. Probate can be complicated if you are unfamiliar with Nevada law. At Trent, Tyrell & Associates, our Las Vegas probate attorneys have experience with all aspects of probate. We can also help clients with non-probate transfers involving life insurance, annuities, qualified retirement plans, and trust assets of the deceased. Probate administration requires achieving the goals and wishes of the deceased person, satisfying the requirements of the state and federal government, as well as probate court. We work to avoid as many complications as possible.
• Estate and Trust Administration and Probate
In many instances, the initiation of a formal probate proceeding may not be necessary. For example, when family members survive the death of a loved one whose assets do not exceed $100,000, our firm may be able to assist in setting aside the assets of the estate to a surviving spouse and/or minor children in just a few weeks without the delay and expense associated with administrations involving larger estates. Just ask one of our attorneys if this proceeding is right for you. Another means to realize a quick distribution of a decedent's assets can be accomplished by the completion of a small estate affidavit if the total value of the assets does not exceed $25,000. When properly established, assets in a special needs trust are not counted against the child when qualifying for government benefits (Supplemental Security Income (SSI) and Medicaid). Willfully passing bad checks to obtain money or property is usually a misdemeanor, but rises to the level of a felony under Nevada law if the amount of bad checks passed is more than $250 in a 90-day period. Penalties for passing bad checks include up to 6 months in county jail, fines of up to $1,000, and payment of restitution.
