Areas of Law
Areas of Law Description
Our practice areas include:
- Mesothelioma Litigation
Mesothelioma litigation is a type of toxic tort lawsuit typically brought against manufacturers, distributors, and suppliers of asbestos, a known hazardous substance used at one time in many products. Mesothelioma cases usually involve people facing terminal illness and great hardship. Even so, these cases can be difficult to prove. With a national presence and a wealth of experience prosecuting mesothelioma cases, our firm provides aggressive representation throughout the entire course of litigation.
- Birth and Childhood Injury Litigation
Our birth injury litigation practice focuses on birth defects, developmental delays (including autism), and childhood cancers resulting from toxic chemical exposures in the environment and from dangerous medications. Our attorneys work with highly qualified scientific and medical professionals to determine if a child's injury is related to a parent's exposure to harmful chemicals and pharmaceuticals.
- Pharmaceutical Complications
Even drugs that people believe to be safe can cause severe injury or death. When manufacturers do not fully disclose potentially serious side effects, the public is at risk. Several medications traditionally thought to be safe for expecting mothers and their unborn babies have been found to cause birth defects. For example, recent studies link autism to a mother's prenatal use of certain anti-depressant medications, including selective serotonin reuptake inhibitors (SSRIs).
- Birth Defects and Chemical Exposure in the Workplace
Our birth injury litigation practice focuses on birth defects, developmental delays (including autism), and childhood cancers resulting from toxic chemical exposures in the environment and from dangerous medications. We, at Waters, Kraus & Paul, work with highly qualified scientific and medical professionals to determine if a child's injury is related to a parent's exposure to harmful chemicals and pharmaceuticals.
- Qui Tam Whistleblower Litigation
Fraud against the government takes many forms, from false Medicare claims to price-fixing on government contracts — leaving taxpayers to foot the bills. Our firm has the in-depth qui tam experience and steadfast commitment to see every claim through until justice is done.
- Corporate Malpractice and Negligence
Our lawyers have represented individuals from around the nation and abroad who have been harmed by substandard professional care (malpractice) or the failure of an individual in the professional community to use ordinary care and judgment (negligence).
- Class Action and Consumer Fraud
Class Action Lawsuits are defined as "groups of people suffering similar harm or losses caused by corporate misconduct, consumer frauds, defective products, business frauds, and discrimination." Our interest lies in protecting the public from violations of federal consumer fraud protection statutes.
- International Litigation
For more than a decade, our attorneys have provided international litigation services for clients from around the globe, including three foreign governments. Specific areas of focus in the international arena include tobacco litigation, exposure to pesticides and other harmful chemicals, and a variety of governmental claims against multinational corporations.
- Drug Injury
Many prescription drugs that most patients believe to be safe can cause severe illness and death. In a rush to bring new drugs to market, the pharmaceutical industry often exerts more effort focused on profits than on consumer safety. Oversight by the U.S. Food and Drug Administration is not always sufficient to prevent a dangerous drug from causing life threatening injuries and illness.
- Love Canal Toxic Exposure
Love Canal, originally named “Model City” in the 1890s, was the failed brainchild of William T. Love and was abandoned before it could be completed. The land, eventually sold to Hooker Electrochemical Co., was used as a dump for chemical waste from 1942 to 1953. It was then covered with soil and sold to the Niagara Falls school board. A school was soon built and a working-class neighborhood flourished over the old chemical dump. Then, hazardous waste began seeping through the top soil. If you are a current or former Love Canal resident and believe you have been harmed by Love Canal toxic contamination, we can help.
