Areas of Law Description
WINHELLER Attorneys at Law provide legal representation and services in the following areas of practice:
- German and International Business Law
We advise and represent German and international business companies, nonprofit organizations, high-net worth individuals and artists with regards to all legal questions that arise in the national and international business law field. Specifically, we provide legal counsel and oftentimes litigate cases in corporate law, labor and employment law, tax law, capital market law, competition law, copyright and trademark law and general contract law matters. Many of our clients come from outside of Germany, especially from the USA, Russia, India, and the People´s Republic of China.
- German and International Intellectual Property Law
Our specialized IP law attorneys work on high-profile copyright and trademark cases - out-of-court and before the courts.
- German and US Securities Law
Over the years, WINHELLER Attorneys at Law have advised numerous aggrieved institutional investors and high net-worth individuals on how to recover stock price losses suffered due to the fraudulent behavior of officers and directors of publicly traded companies and their auditors. We mainly represent our clients in German-style "class actions" before German courts. Together with our cooperating US partner Kessler Topaz Meltzer Check, LLP (USA) we also inform our clients on how to actively participate and claim their damages in US securities class actions.
- The Law of Private Foundations
Since the firm's formation we have been providing legal advice to foundations and high-net worth individuals on all legal and tax law issues regarding the German and the US law of private foundations. Our attorneys accompany you from the time of drafting of all required legal documents for setting up a new foundation up to counsel on all legal and tax issues coming up in the day-to-day work of your foundation. Of course, we are also dedicated to represent you before the governmental foundation and tax authorities, if required.
- The Law of Nonprofit and Charitable Organizations
An important field of attention WINHELLER Attorneys at Law focus on is legal and tax counsel for nonprofit and charitable organizations other than private foundations. Since most nonprofit organizations are tax-exempt, tax law issues play an important role in this regard. Other fields of law that are of special interest for nonprofit organizations are, among other things, labor and employment law, sponsorship and charitable giving issues, counsel on the formation process and the choice of the proper legal form, and how to preserve the nonprofit status over the course of time.
