No matter what the medium, be it teletype or Twitter, the Model Rules of Professional Conduct delineate the ethical guidelines and restrictions within which attorneys must operate when embarking upon a marketing campaign. Commonly arising issues in this arena include the unintended client, confidentiality, conflicts of interest, solicitation, disclaimers, liability issues including the standard of care and defamation, and pretexting. Learn how to deal with these issues and get some useful tips on structuring on-line marketing disclaimers and other devices that avoid many of the pitfalls in the first place. Our panel will provide practical advice about the techniques themselves, and how to comply with the duties identified in the Model Rules in the modern and increasingly technology-driven world of practicing law.
