Slip and Fall

SLIP AND FALL-YOUTUBE

Paul d'Oliveira attorney from the law firm of d'Oliveira & Associates.

Slip and fall accidents. You need to show two things in order to be able to recover or get a settlement rather from a slip and fall accident case. One is negligence, we need to prove that the party other than yourself, the person responsible, whether it’s a homeowner, or business or a landlord is negligent or at fault. Where going to get into some common types of negligence cases. The second thing is insurance, we need to have insurance to recover, unless the person who is at fault has a lot of assets, but that’s not usually the case, usually if someone has assets than there going to have insurance. So some common types of slip and fall cases that we've seen and remember we have to prove that it wasn't the person who slipped and fells fault, but we need to prove that it was someone else’s fault or negligence in order to recover. So the most common type is a defect. Typical type of situation is somebody is up on the second floor, there renting from their landlord, their landlord either knows or should have known about some type of a defect, like a hand railing, or a light bulb was out, or the stairway was broken or a number of different types of situations and that was the cause of the person getting injured. So a person is walking down the stairs let’s say, they go to grab the handle rail because they lose their balance and the handle rail either isn't there, it’s broken or pops out of the wall. So that's your typical type of cases of defect. Another type is, we see a lot of is, holes in parking lots, especially with commercial places where we see these. If a person owns a commercial property they are responsible to keep the parking lot safe and a lot of times, especially in New England you get a lot of snow and ice, you get these holes that form inside parking lots and a person can fall and break an ankle or hurt their back or whatever. Another situation we see a lot in this New England area is ice and snow. Those are a little trickier, these ice and snow cases, but essentially we have to be able to prove that the person, such as the owner of the property or the landlord or the person who owns a business should have shoveled and sanded to remove ice and snow. Typical type of case that we see is with gas stations were a person goes to pump their own gas, they go out to their car and there is a patch of ice and they slip and fall. Well that's negligence in my opinion, know they are always going to argue that you should have seen it or whatever, but in that type of situation we usually can settle those types of cases. But anyways it’s an involved situation, if you have a slip and fall case feel free to call us toll free or fill out a contact form in confidence as we would be happy to discuss your case with you. We charge no fee until you obtain a settlement or recovery and you would be able to recover for your lost income, medical bills and for pain and suffering. Thank you.

Rhode Island Dog Bite Cases

RHODE ISLAND DOG BIT CASES

Paul d'Oliveira attorney from the law firm of d'Oliveira & Associates.

Dog bite injuries. If you or a loved one has been bitten by a dog, and you contact our office. The first thing we are going to ask you is, does the owner of the dog have insurance? Or do they own a home? If, they own a home either the owner of the dog or where they live in the home that’s owned by someone a relative, then there is going to be what they call home owner's insurance. Which covers dog bite injuries, it covers things for medical bills, lost income, pain and suffering, any scarring or permanent disfigurement. Know if the owner of the dog lives in an apartment, then sometimes there is coverage, but usual not, so it’s a little bit trickier. We can still sometimes find coverage or if the owner of the dog doesn't have insurance, but has assets but that’s usually unlikely, most people who rent don't have a lot of assets. So if you or a loved one has been bitten by a dog, as I said there is a number of things you can collect for medical bills, lost income, pain and suffering and disfigurement. We've gotten some pretty good settlements over the years for people, for dog bite injury cases. One of our better ones was for four hundred thousand dollars were we got a young boy who got bitten on the face and pretty bad, he had some plastic surgery and we dealt with home owners insurance company where we were able to obtain a settlement for about four hundred thousand dollars for this young boy. We structured the settlement, so that he got the money when he turned eighteen. Sometimes we can structure it where they get the money over a few different years after their eighteen. We obtained another settlement of about three hundred thousand dollars for a person who had been bitten in the ankle and had a severe puncture wound by a dog and we dealt with the home owner’s insurance company. So we have a lot of experience in handling these types of cases. Our firm charges a third, which is pretty standard that most lawyers charge for this type of personal injury case. There is no fee until we obtain a settlement for you, we also pay for any costs along the course of the case, for professional photography, investigative costs, whatever we get those back at the end of the case. And feel free to contact us either calling us toll free or fill out a contact form online as we would be happy to discuss your case and determine whether you have a case. Thank you.

Mass Auto Accident Injuries
Paul d'Oliveira from the law firm of d'Oliveira & Associates.
Automobile accidents in the state of Massachusetts. If you or a loved one has been injured in an automobile accident in Massachusetts, even if it’s your fault on your insurance coverage in Massachusetts if you’re a Massachusetts resident you have what they call PIP (personal injury protection), which will pay for your medical bills and lost wages up to eight thousand dollars. Know if it wasn't your fault you not only have that coverage on your car but you can also bring a bodily injury claim against the other driver's insurance company person who was at fault. In Massachusetts that person has to carry a minimum of twenty-thousand dollars in coverage. What would you be able to collect for? Well most people who are injured in an accident they can collect their medical bills, their lost income even if it exceeds that eight thousand I talked about under the PIP, they would be able to collect for pain and suffering, any type of disfigurement if there was a scar as well. Our firm charges a fee of the not on the PIP, but on the liability settlement. The major problems we have seen from people in car accidents that we advise them to not do are to have gaps in their medical treatment. As long as they are in pain it needs to be documented by medical treatment, we see people at times that just for various reasons don't go to the doctor for long periods of time, even though they are in pain it's hard for us to get them money for pain and suffering during that period. Also, we have seen people with residual pain, which means even after their done treating they still have back or neck pain or other types of pain that continue from time to time this also increases the value of your case, but again it has to be documented in your medical reports with your doctor, we review those well when we speak to you and review your medical records to make sure that your doctors are putting it in their reports that you are telling us. So feel free to contact us either online with a contact form in confidence or call us toll free as we would be happy to discuss your case. Thank you.
