Every personal injury firm uses the same fee structure – the attorney receives a 33.3% contingent fee award (Don’t be fooled by all of those “no fee unless you win” ads. Those firms are not offering anything special. It is industry standard. And everyone offers a free consultation.), and the client is responsible for costs. In fact, under the Michigan Rules of Professional Conduct, an attorney may not pay the costs associated with litigation. Sometimes, the attorney advances costs, but at the end of the day, the attorney is reimbursed any costs advanced. See MRPC 1.8(e)(1). It is important for the client to know what costs are being incurred and why. Our clients are never kept in the dark.
